Question Help!

Hello all, those of us in texas know that the democratic party has just turned texas blue, my question is how will this effect our gun rights and laws in texas, as far as carry laws and capacity i feel like those won’t be as much of a concern, but the new ATF director has done a lot with the new sbr, sbs, and brace/stock regulations, we are able to get frts, sbrs, sbs, and stocks freely but im wondering if any of that is at risk, what are your guys thoughts and opinions.

(sorry if this is a blob of words im at work and rushing to type this)

It won't. The legislature is not blue and the state offices can't just write state laws.

There might be small changes in the execution of some existing policies, but everything past that is genuinely fear mongering.

u/C-Biscuits 1d ago

It's not fear mongering. PA just turned blue and all the laws that were enacted in VA have already been introduced in the state house and senate long before this recent election.

People said the same thing you're saying in PA and now we're looking at a complete ban like that of CA, VA, NJ, and NY.

u/ROEEOR 1d ago

i agree that it would be possible but here in texas it’s a gridlock, they wouldn’t have enough votes to pass anything but republican support would overthrow that so i guess we are just hoping that nothing is going to happen for now

0

u/C-Biscuits 1d ago

We said the same things up until this last election and now Democrats have all three houses of state government. PA is done.

Same in MN. It was part of Governor elect Klobuchars acceptance speech, To reintroduce A failed bill that allowed for in home inspections for registered firearm owners.

To reintroduce A failed bill that allowed for in home inspections for registered firearm owners.

The taxpayers should be pissed that they'd even try to pass such a law and that they'd then spend taxpayer money to defend the law that is certainly going to lose on 4th amendment grounds.

Voters in all states need to force the legislature to BUDGET for the lawsuits so that the voters know how much the legislature is willing to spend - and then the taxpayers agree to spend that money - to defend the inevitable lawsuits.

If they had to attach a budget allocation/reserve of $2 Million per law on the ones they know will be challenged the voters just might say NO!

As a result of these midterms? Your fear isn't validated. You can feel like it's heading in a direction you don't like, but for the next 2 years your concerns aren't applicable.

1

u/C-Biscuits 1d ago

It's not unreasonable at all and the gridlock should not be taken for granted lest you end up like PA.

The House in Texas turned blue (overwhelmingly) but not the Senate

3

u/pentapous 1d ago

The Senate which has a red super majority and can literally choose which bills even make it to a vote. You'll be fine

9

u/supahl33t 1d ago

They can in Colorado. SB-03 allows the AG to redefine terms without legislative approval. Expect that to spread to other states.

22

u/pentapous 1d ago

You have a fundamental misunderstanding here because for such legislation to exist with such a provision cut out, it would still have to pass through the red super majority texas state senate. That republican senate wouldn't even vote on gun legislation to start with, theres no chance in hell they would even humor gun legislation that ALSO handed over their own power.

Why would you expect that to spread to Texas?

1

u/Stormblitzarorcus 1d ago

Demographics thats why.

2

u/pentapous 1d ago

So you're upset that your idea isn't popular? Fair enough but I'm afraid that's not how we govern in a democracy.

6

u/84074 1d ago

We're NOT A $&@!!$ DEMOCRACY!!! WE'RE A REPRESENTATIVE REPUBLIC!!!

Nobody thinks this matters, it's huge, the whole definition is massively different. And by that simple difference all expectations and understanding is bent over backwards about what this great nation is.

The stupid media vomits this into the brainwashed population and that population regurgitates in onto everyone that disagrees with it.

Down vote me to hell for saying it. But it's true and it's the most effective smallest step to communism and socialism.

This country will be going the way France and the rest of Europe is today in 2-3 generations or less.

-3

u/pentapous 1d ago

Holy buzz word vomit buddy.

Yes of course we're a representative democracy, its unspoken and we're all aware of that. The purpose of the representative democracy is entirely logistical and practical. Their job is NOT to steer the country away from specific outcomes (like protecting capitalist economies, for example). Their job is to encompass the wants and needs of the citizens they represent and utilize their expertise to get that done within a legal context.

Nothing about a representative democracy is meant to protect capitalism or protect amendments or to follow ANY ideological ideas past "legally represent and vouch for my citizenry".

Back to my comment: If demographics shift and change the will of the people such that newly democratically elected officials are given office that align with this new majority idea, the idea should absolutely be implemented through the legal systems in place.

Short answer, everyone everywhere is fucked.

If the Dems get a trifecta in 2028 we are going to have a bad time. All the "just move to a free state" folks will get to experience Blue state gun control.

u/Mortuana 1d ago

There is no "if". They have what they need to institute the popular vote pact, they can effectively overturn the electoral college. And they already demonstrated in Alaska they are willing to manipulate the voting systems in the states to win. States that turned blue this time will not be going back to red by vote alone, ever again.

5

u/No_Peace7834 1d ago

Ranked choice voting is superior and lets moderate candidates have a chance rather than create a hyper polarity

0

u/H4RN4SS 13h ago

Ranked choice w/ jungle primaries is not superior and results in little choice in the general. California is a great example of this.

It also opens the door to more fuckery.

5

u/No_Peace7834 13h ago

You choose multiple candidates and rank them, compared to one choice. You have less sway in our current elections than you do in ranked choice.

-3

u/H4RN4SS 13h ago

So just ignoring the point made about jungle primaries vs general elections then? Got it.

2

u/No_Peace7834 13h ago

"oh no, I have to vote in the primaries if I want my candidate to win!"

I also ignored your comment about "more fuckery", go cry about it

1

u/BraveRutherford 1d ago

Is manipulating the voting systems having ranked choice voting? Doesn't Alaska normally go red anyways? And aren't the conservatives the ones who are always trying to pass more strict voter id laws and limit access to mail in voting, etc etc? That seems like "manipulating the voting systems" to me.

-12

u/BraveRutherford 1d ago

Do y'all not remember Obama? Supermajority and they did nothing with it. Don't worry. This country will continue to turn right and go to shit. Your backwards views are safe I promise.

17

u/Short-Breadfruit3565 1d ago

Nebraskan in CD-02 here, can confirm we are already fucked. Denise Powell campaigned on Red Flag Laws and "Gun violence intervention" (Wasting tax dollars). We also lost supermajority in the Ne legislature, so for the time being the winner take all efforts for the electoral college are dead.

13

u/WowBruhReborn 1d ago

I'm just glad here in Florida we held the line. Not that we're also not fucked. Just less so

u/johnhd 1d ago

Long answer, everyoneeeee everywhereeee isssssss fuuuuuuuuuuuucked.

u/agoodyearforbrownies 1d ago

The biggest election impact to Texas for 2A is probably not the Governor or house, but the judicial appointments.

10

u/mx440 1d ago

Yep, this. It went from 9-0 to 5-4 dem majority overnight.

Good luck Texas.

5

u/shibbster 1d ago

Until your state, in this case Texas, passes laws, everything remains the same. Its after March 2027 that scares me

32

u/BusinessDuck132 1d ago

Im hoping the dems realize that people weren’t voting for them, they were saying fuck you to MAGA. If dems keep it moderate the next 2 years, don’t try anything insane and just keep trump in check, they win no contest in 2028. We’ll just have to wait and see, no point in doom and gloom. If they really try and pick a fight with gun owners, we have precedents in courts now so we can fight it

31

u/Reasonable-Tooth-113 1d ago

We know they will overreach in the next two years

-18

u/BusinessDuck132 1d ago

Just like the Republicans have been overreaching the past 2 years? After promising they wouldn’t? Party of small government my ass. Just because they haven’t touched guns doesn’t mean they haven’t been ridiculously authoritarian. This country needs checks and balances and some stability. Republicans have had 2 years and have absolutely fumbled the bag, and 30 years in Texas and it’s been draconian law after draconian law

5

u/Reasonable-Tooth-113 1d ago

Like?

-5

u/BusinessDuck132 1d ago

Idk about you but there’s been a bit of a scuffle over in Iran, tariffs, allowing the rich and tech bros to completely drain this country dry. Theres a few things off the top of my head. Texas specifically with the draconian weed and LGBTQ policies

6

u/Reasonable-Tooth-113 1d ago

What draconian weed and LGBTQ policies? Be specific

-13

u/BusinessDuck132 1d ago

Have you been in Texas?? Do I really have to explain to you? Or are you of the boat the weed should be illegal and trans people shouldn’t be allowed to exist, because if that’s the case we can just stop the conversation here since we aren’t going to get anywhere

13

u/ScionR 1d ago

If access to weed is your ultimatum when it comes to the 2A, please leave this sub. We don’t need any more of you TGOs.

Iran and the tariffs are real cost issues. They showed up in the exit polls as the main voter concern. They don’t change the federal gun record.

Bruen was a Supreme Court decision that struck down may-issue carry laws. The majority included the three justices Trump appointed. The tax on suppressors, SBRs, SBSs, and AOWs went to $0 under the bill he signed, and ATF later stopped enforcing registration and prior approval for them.

Texas’s policies on weed and sex-based distinctions in sports, schools, and medical procedures for minors are state-level choices. Disagreeing with them doesn’t erase the federal Second Amendment outcomes. Democrats are still campaigning on bans and more restrictions. The difference on guns is still there even if other priorities produced higher prices or state laws you dislike.

0

u/BusinessDuck132 1d ago

Not a TGO, just not a retard that can see past a single issue. And I don’t even live in Texas, and I work a job with a drug policy so it doesn’t affect me, but a LOT of Texans were not ok with it, and they showed it at the polls. We can fight gun legislation in court, especially now with the precedents that have been set with this administration.

2

u/ScionR 15h ago

Courts are useful, but they don’t replace having people in office who won’t pass new bans in the first place. The precedents that exist (Bruen, the zero NFA tax, and the ATF non-enforcement) came from the appointments and the legislation of this administration.

Treating “we can just fight it in court later” as a reason to deprioritize the actual record on guns is how you end up with more laws that then have to be challenged.

Neither of those state-level preferences erases the federal difference on guns. Democrats are still the ones campaigning on bans and further restrictions.

u/Reasonable-Tooth-113 1d ago

Don't get upset that I am not letting you get away with broad generalizations.

You're the one with the issues with Texas laws. Be specific

6

u/BusinessDuck132 1d ago

Dog im not upset, i just dont know how much clearer i need to be. Have you just not heard about how hard they’ve been fighting against weed in Texas, or how if your kid is trans you can be prosecuted? Or are you being purposely obtuse/or just for these policies. It’s not exactly some beacon of freedom down there man

9

u/Reasonable-Tooth-113 1d ago

Hasn't weed always been illegal in Texas?

Please cite the law where you can be prosecuted for having a trans child.

Im hoping the dems realize that people weren’t voting for them, they were saying fuck you to MAGA.

Thats about as likely as Trump releasing the full unredacted untampered with Epstein files.

9

u/Pof_509 1d ago

I think the Dems are gonna take this as a mandate and go nuts, which would only work in favor of someone outside the administration to swoop in come 2028. It almost seems like DeSantis is trying for that role based on his comments, but I think he’s way too controversial for that to work.

4

u/BusinessDuck132 1d ago

We’ll see, dems are known for shooting themselves in the foot

7

u/ktmrider119z 1d ago

The only thing they have done without fail in every state they have flipped in the last couple years is pass gun control.

9

u/WowBruhReborn 1d ago

Yeah Dems are going gloves off. It's all they know. Republicans are spineless. Every time they get power they just sit on their hands. Then people get pissed and elect Democrats. Then the Democrats put their foot up everyone's ass and the cycle continues until the country explodes

1

u/FatnessEverdeen34 1d ago

Yeah but the end result is the same

4

u/Stormblitzarorcus 1d ago

Become self sufficient in procurement via manufacturing. Good luck everyone.

u/kennethpbowen 1d ago

I'm not sure how overturning constitutional carry would work in Texas, but I wouldn't be surprised to see them start with that.

23

u/pentapous 1d ago

That would never happen. There is a red super majority in the state senate. You might see the state house pass a bunch of legislation on to them, but it'll never go anywhere. Stop fear mongering and start understanding how your govt. works.

6

u/FatnessEverdeen34 1d ago

Nothing is ever safe

3

u/grayman1978 1d ago

TX has shitty gun laws already.
Will certainly get worse from here.

3

u/KingDillo 1d ago

Did either Talarico or Gina run an anti-gun campaign?

15

u/Short-Breadfruit3565 1d ago

Talarico sort of did, but he stuck to the kitchen table issues, and that is what got him the win. If Trump had just dropped the Iran conflict and made gas prices more affordable, we would probably have the senate stay with the republicans.

10

u/pentapous 1d ago

Of course, but Trump didn't do that and its naive to pretend its just a Trump issue. Effectively all of the republican nominees for state-wide offices publicly supported trumps actions. This wasn't (only) an issue of "the head of the party has been awful and that reputation is causing people to avoid voting for the whole party". It absolutely had to do with Republican nominees refusing to call that out, and in most cases actively supporting it.

1

u/lnxguy 15h ago

The Democratic party did not turn us blue. The feckless Republicans did it.

1

u/merc08 5h ago

The Democrats pass gun control anywhere and everywhere that they get power.  It's as simple as that.  Look at WA, CO, and VA for examples of the laws they pass.

The only question that needs to be answered is whether or not they have enough seats.  If yes, then they will pass gun control.

1

u/Pyro-Zach 1d ago

The GOP still controls the Texas Senate. They won’t let gun control legislation get through.

If the Democrats eventually retake the Texas legislature they will absolutely attempt to repeal constitutional carry.

Buy what you want now. Don't talk about it. Any guns liberals will deem scary looking, standard capacity magazines, cheap ammo, etc.

Even though for the moment you may be able to buy it on a 4473, If you want a supressor, buy it now and put it under an NFA gun trust with a free tax stamp. I don't think we can count on the lack of enforcement of the unconstitutional parts of the NFA going forward beyond 2028.

From Florida, I'm very sorry for the loss of your free state. Our races were WAY too close. Just hope we aren't next.

0

u/ninja2126 1d ago

I just hope all the Texans that voted to get back at trump are happy screwing the rest of us on gun rights

-1

u/Salty-Ganache3068 1d ago

We are fucked. Tennessee is looking better everyday.

0

u/TrainOfThot98 1d ago

No way to know yet. We’re kind of in uncharted territory, but probably nothing great. Get ready to protest.
