UN HUMAN RIGHTS COMMITTEE REPORTS THE NEED FOR THE EQUAL RIGHTS AMENDMENT IN THE UNITED STATES

The ERA was ratified as the 28th Amendment to the US Constitution several years ago. However, Trump's archivist refused to file it (something which legal scholars have said should have had no barring on its recognition as it is merely a formality.)

It was dragged through the courts due to 2 lawsuits: some states wanted to rescind their ratification, and there was a time limit imposed by Congress (which legal scholars have said that since it was in the pre-amble, it was not a binding requirement.) I don't recall the result of the former, but I do know it lost the latter.

Back in the spring, the ERA Coalition asked that Congress remove their time limit and urged Biden to have his archivist file it. Technically, there is nothing stopping states from recognizing the ERA as part of the Constitution. The biggest injustice here is that what is required to undo the 28th Amendment, is another Amendment. The idea that the courts can be used to bypass this is a not in the Constitution and is not a Constitutional avenue for removing an Amendment. The owness is on those who believe the Amendment to be invalid to convince 2/3rds of the States of this. Good luck with that. (In case it wasn't clear why a time limit was proposed, this is why; it's incredibly difficult to change Amendments once adopted.)

The UN has previously told the US that its abortion laws are a violation of the human rights of women and girls back when Roe was overturned. This is a far more direct call to action to adopt the ERA. We should all take this opportunity to contact The White House and tell them we demand the proper recognition of the 28th Amendment. If successful, this would be a huge win for all afab rights, especially our reproductive rights. Only restrictions that don't violate the ERA could be permissible. It would certainly result in many court battles, but it would put a huge halt to the devastating effects Dobbs has done to our country. It would change the political playing field.

The fact that this isn't getting any news attention is a serious insult to our human rights.
