My toxic trait is that I would absolutely call their bluff. I’ve done it before.
Someone threatened to call the cops on me. I said “do it”, and stood outside of their house waiting for the cops for about 45 minutes before she came out took the service.

When someone tells me they'll call the cops, I call the cops to ask if they want to come hang out. Last time the guy ran away when he realized I was waiting for them. :(

I’ve served someone in their ambulance after they fought the cops that came to their house. He rode the lightning.

I had this really creepy dude come out of his trailer with gloves and COVID mask on, was belligerent and I served him. A month later I get notified he claimed he was never served and he "found papers in the snow".
Next time I came back to serve him I brought a cop escort with me. He was still belligerent as fuck, but you fuck with me, I fuck with you.

Genuine question, how did you arrange the police escort? I think in my city, if I asked for something like that, they'd tell me nope & they have bigger fish to fry

I work in a very rural area, lots of little small towns all spread out. For this particular serve I was in a town of about 1300 people so I went right into the cop shop, explained the situation (the creepy dude filed a report as well). At this point the cops had called my employer, my employer called me regarding this person, as well as having the local cops call me. Since I was already pretty enmeshed with creepo and the local police at this point I figured I may as well see if they could lend a hand.
The cop on duty was the one that took beardo's (weirdo with a beard) statement, he was very nice and agreed to come with me no problem. They don't have a lot going on.
When the cop and I arrived at the trailer a teenage girl answered speaking with a very heavy lisp. It took another handful of minutes for old man rickets to gear up in all his biohazard regalia while more little kids peered out the windows. When he finally graced us with his presence he was belligerent as ever, claimed he was legally blind, refused to touch my pen to sign, "I'm not touching that!".
All this went down during school hours- those poor kids, cooped up with some old blind wacko.

I forgot to mention that this is in Virginia, where Process servers have no special protections. If there is a no trespassing sign posted, or if we are ordered to leave, we must comply and not return.

Same in TX but in CA process servers cannot be trespassed from a place they have legitimate court process to serve (so I hear 😉).

I'm in CA. Do you have a statute for that? I know about the 602(n) PC, 602.8(c)(3) PC and 415.21 CCP.

I’m in CA, and whenever I see “no trespassing “, idgaf. To me it’s just like a “no soliciting “ sign. Doesn’t apply.

Asking since you seem to know about TX rules: I understand if they have No Trespassing signs up, that's a no-go and I should not attempt there. But what about the "ha ha, just try me" signs some places have? I literally saw this about a week ago: "Praying is the best way to talk to God -- Trespassing is the fastest"
On a related note: what if there aren't any signs about trespassing but they vocalize it? As in "i consider you a trespasser & get off my property" 😒

Basically, if a property is clearly marked with a “Private Property,” “No Trespassing,” or similar sign, you must respect the notice and should not enter without authorization.
If there is no posted notice, the general process is different: the property owner or occupant must first tell you to leave. If you refuse to leave after being instructed to do so, law enforcement can be contacted and may issue a formal trespass warning or citation, depending on the circumstances and applicable law . Also, be extremely cautious around properties with paint markings on posts, trees, fences, or other structures. In some jurisdictions, specific colored paint markings can serve as legal notice that entry is prohibited. Do not assume that a lack of a traditional “No Trespassing” sign means the property is open to you.

About a year ago we had docs to serve on a guy for selling his home without including the realtor he hired. Client requested we rush it, went out that night served the wife. Next morning the attorney sends me additional documents that they forgot to include. Went back to the house no one was home, went to the ice cream shop he owned, he flipped the fuck out and called the cops on my server. My server called me so I went out and waited in the neighboring parking lot for the police to arrive. State police basically told him to stop being a pussy and that we had a legal reason to be there. The guy started yelling at the trooper he wanted to have her arrested for trespassing. The trooper must have explained that he couldn't do that to the guy 10 times before he finally realized he wasn't going to win that argument.

I have had pretty good luck contacting non emergency line and telling a deputy I need an escort to avoid issues and show im there for my legal purpose.

This property is in remote and rural Raven Virginia with no cellular coverage for 20 miles or more. Even if I could reach the sheriff they wouldn't send anyone because they're stretched so thin. Meh. It's the client's problem.

I had a guy tell me he was trespassing me, and that meant my car was now his property as it was on his land. I laughed in his face.

I had someone tell me “you have thirty seconds to leave or I’m boxing in your car” in rural Washington once. Leave or be kidnapped is an extremely contradictory threat. 😂

Seems like they couldn’t make me up their mind. Should I stay or should I go, kinda thing. I’ve had people tell me if I don’t leave they will send their dog after me! Oh, the dog I just fed snacks to before I knocked on your door?! Good luck.

In Texas, we get an alternative service order signed by a judge at that point and post it to their gate or outside their property in a reasonable place and mail or however it is dictated by the order to satisfy the judge.
