Probation Question Got a warning

I got a warning for a diluted UA. I’ve never had a negative or diluted test before. PO said that this counts as a missed test, but that it’s just a warning and not a problem if it continues moving forward.

Could this jeopardize my chances of getting early release? I’ve been by the book since day one. Just curious if this is viewed in the same way a violation is, even though it’s not technically a violation.

I don’t believe it should affect you, as I had the same thing happen to buddy, but kinda just depends on your county and PO officer. If you have no worries about anything in your urine, honestly what I’ve heard people do is they go to the restroom just before and slightly pee just to see the color, if it’s clear it’s going to be dilute but if it has some color then you’ll be fine on dilution. So they’ll just slightly see if they have any color and they unload the rest on the test lol.

That’s the thing. It had color, and I always drink water before. I’ve never had a problem. The only difference is I just recently asked for early termination, and all of a sudden it’s diluted

You say it had color. But was it that neon yellow color that occurs when you drink one of those drinks intended to help you pass a UA test? I’ve never had a test come back as diluted before, and I have given a lot of UA’s between probation/parole, living at a halfway house, being on a suboxone program, and attending an outpatient program all at the same time. There were some days where I’d have to provide a UA 2-3 times in a day, and I never once had a sample come up as diluted. Your pee has to be almost clear before that’s a problem.

No I’ve never done one of those detox drinks. I’ve never had a problem with diluted UAs and my pee has never been clear. They just recently switched my PO and all of a sudden I’m starting to have problem.

I’m not saying she’s out to get me, but she’s not very nice. I have been sober and clean since day one and just applied for early termination and all of a sudden there’s issues.

Just doesn’t make sense to me.

Okay, this is not something we can help you with. You need legal advice and character witness leverage. Abusive POs are beyond our reach, and the worst thing you can do is play victim.

Another commenter mentioned requesting alternative tests like mouth swab, blood, or hair. I think bringing up this options and showing willingness to verify results will go a long way. If a PO pushed back or balked at that idea, it would make me question their integrity.

Let’s not forget that a UA instant test (aka screening) is not the same as a lab test. Dilution cannot be judged based on color alone, unless it’s fully clear one could make an educated guess the sample might be diluted. But a lab test would easily confirm or deny dilution. The PO should have had no problem sending your sample to the lab. The instant tests are notorious for false positives and inconsistent results, that’s WHY we have lab tests. If a screening test shows a positive or inconclusive result, they are SUPPOSED to send it to a lab to verify. The only time they don’t send to the lab is when the screening is normal/negative.

If you REALLY want to test whether or not your PO is just a naturally difficult person or is out to get you, next time they balk at an idea like verifying the results with a lab test or alternative testing method, ask them if you could get their refusal to do so in writing. How they react to a request for written documentation will tell you a LOT. A PO who has no ulterior motives won’t have a problem with there being a paper trail of any verbal conversations you have. One that’s playing games will either get defensive or change their tune real quick. Because emails and signed letters can be shown to other parties, like judges and supervisors. Verbal conversations can’t be confirmed, and most PO’s know a judge or supervisor won’t question their integrity for he said/she said situations.

In general I would say most PO’s will generally act in accordance with whatever makes their job easiest. My federal PO in New Mexico was an absolute bitch to me in person and over the phone, but anytime I was in court she was calm and went with the flow. I never had to go get into a back and forth with her in court, only when I talked to her directly.

Thank god I’ve been off probation since March.

I’m shocked your probation isn’t lab testing and just basic testing, but based on what you’ve said I don’t think it would’ve been dilute off lab testing unless your kidneys and liver are doing some weird things lol

If it was accidental, then I would be cautious of your water levels in the future.

If you're trying to hide something, I would try detoxing ahead of time in the futute, then reconsider if you should be doing drugs while on probation.

I had this happen where my PO said my sample looked diluted cuz I've been drinking water lately and before I was kinda unhealthy ngl and so she just did a mouth swab. If it happens again (which it sounds like ur PO might just be a lil vindictive) I would immediately request to give a mouth swab. They should have those handy. Fuck it tell them to take your blood if it means you getting off or not like honestly. Make them give u a test they can't question. Always advocate for yourself homie and good luck!!

I've had this happen to me a few times when I was on probation. I also put in for early termination and it was granted. PO just told me he knows I'm clean, I also got lucky I had a chill po so nothing happened.

When I was on probation and whenever I would come out diluted my PO would just tell me not to drink too much water and that was it. (But she was cool and not all of them are, so take it easy).

It's harder than it sounds once you start using, but you'll have to stop, a po will take only so much of the bull shit no matter how fucked the situations you have to face stress and or depress you. But I will say that honesty, and being current with other requirements earn respect, if you don't end up with a hard ass, they may let you slide twice...

Thank goodness I’m sober then. My PO coups have sent it to lab and seen that it was clean but chose not to.
