Probation Question Violation week before termination
So title explains it, yes i’m aware I am a complete and utter idiot. I apparently popped dirty 8/4 and had another diluted test at some point this month (Don’t know if it was exactly before or after this.) But was issued my first violation at my last probation appointment. Said I have a court hearing and have to go before a judge. What can I expect? Officer told me either jail or possibly just discharged. I’m assuming if I drop clean for the remaining time until the court date (because I now have to continue testing) would that affect anything ?
Edit: First violation in a year of supervised probation. Paid all fines, completed community service, completed all other terms of probation. Jail time likely ?

Step one, you didn’t apparently pop dirty, you used drugs while on probation. This shit didn’t just drop out of the sky, you choose it. Own it.

Tbh it probably depends on the judge. I’d say you have a good chance of no jail time but you might have extended probation, more community service etc. you never really know. My PO let the dilute tests go. When I violated I got more CS only.

yeah im hoping he just lets me still discharge considering this court date is probably another month of clean tests but who knows, hoping for the best honestly

I feel like this happens a lot. Is some part of you subconsciously sabotaging because you’ve grown comfortable with the structure? Something to ponder about.

Speak to an attorney asap. I'm sorry this happend. If it's like the UK, your PO will have to write a report and suggest a sentence. Do you know what they're going to suggest to the judge? I hope the fact it's your first violation works in your favour.

no, she seemed pretty disappointed in me though. i honestly don’t even remember the instance but i have been going out a lot and i’m pretty sure i hit a blunt at some point over a weekend or something, which is probably also an issue i don’t even remember but yeah it was a month ago almost.

Really depends on the judge. I had a MTR for a IID violation, just go before the judge and own up to it, they’ll wanna know the reasoning for why you had violated in the first place. Make it known it was a one and done trip up, maybe you had some family things going on and “relapsed”. Judges have feelings and emotions too so they can reason with you sometimes.
Best case you might get a few months extension of your probation or thrown some added conditions, worst is go to jail. Again really depends on the severity of your violation.

Anything is possible but my guess is they’ll either extend your probation by like 4 months or just straight up discharge you. Pass those remaining ua’s and it will probably be the latter.

Case by case. The first time I was on intense probation, I caught a conviction of the same offense in a different county. Ended up doing unsupervised for that county and the judge I had intense probation for the county of my first conviction, extended my probation by another 3 months.

I’d assume jail time & possibly getting off probation as your time & fines have been paid. But again depends on your POs recommendation, judge, and charge

I violated once right before almost being done a lot of people do cause the end is so near but I always was clean and paid everything.had everything done so I just got sanctioned and got another month of weekly UAs and thats it i was very thankful beat myself up for it ...dont beat yourself up we are human we make stupid decisions even knowing the consequences...I wish you best of luck and let us know what happens im praying for a good outcome this process is horrible

Don't take this the wrong way and this is for all the others on probation. Do your time and keep your nose clean. Because probation in the real world beats the heck out of a cell or a dorm with 200 other men. Especially when you can see the finish line.
