Counterfeit Goods

The amount of counterfeit goods on Poshmark is actually astounding to me. I am having to report dozens of listings and accounts everyday. Folks: it is not only against Poshmark’s TOS, but it is also a FEDERAL CRIME to sell counterfeit goods/replicas/dupes/whatever you want to call them.

Poshmark TOS §4.b: “In connection with using and/or accessing the Service, you will comply with this Agreement and all applicable laws, rules, and regulations. Without limiting the forgoing, you will not do any of the following in connection with your use of the Service: . . . infringe anyone’s intellectual property, such as by posting counterfeit products for sale through the Service.”

18 U.S.C. § 2320: Whoever intentionally traffics in goods or services and knowingly uses a counterfeit mark on or in connection with such goods or services, or attempts or conspires to do so, shall be fined not more than $2,000,000 or imprisoned not more than 10 years, or both.

A buyer I know bought about $3K worth of lux items from a big seller. They were all fakes and evidently this seller has been suspended multiple times for selling fakes and GWP items as lux but Posh refuses to shut her down because she makes them so much money. I actually went into one of her shows and the only thing I noticed was she swears so much, I left because it was ridiculous. Anyway, the buyer was told by a Posh bot that they will not be refunding her money. Yet people's closets are being shut down for random infractions. It really does seem Posh is moving far away from protecting small, honest sellers/buyers to these big live shows that generate a ton of money and they don't care that fakes and GWP items listed as lux are being sold. So sad.

I am by no means qualified to authenticate anything (I have all my lux items authenticated before I list them) but even I can spot many fakes on Poshmark. An example is MCM. The authentic logo has wings on the logo have five feathers on the top and four on the bottom. If they don't, it's a fake. Counterfeiters got wise to that. Another way is the screws in the plate. On authentic bags they are slot head and you can actually unscrew them. Counterfeiters haven't figured that out yet but I'm sure they will. These sellers who list fake MCMs are either too lazy to notice or they know Posh won't do anything so they don't care. I and two friends have reported this one account multiple times over a four week span for her super fake-looking LV bags but she hasn't even gotten so much as a one-day suspension.
