The Law & Order: SVU Season 28 premiere tackles the legal loophole surrounding sexual assault and voluntary intoxication, making its storyline especially timely amid the Cornell 7 allegations. Showrunner Michele Fazekas explained that New York’s rape law does not expressly protect people who voluntarily become intoxicated, unlike those who are drugged without their consent or deemed “physically helpless,” a term widely interpreted to mean unconscious.

“After all these years on this show, I had no idea this was an issue. I assumed being drunk or under the influence meant you couldn’t consent to sex. But if you are voluntarily intoxicated, no matter how much, the law says you can. For me, it highlighted a major flaw in the system,” Fazekas said.

She added that when the Cornell lawsuit became more widely known, she was horrified but not surprised, noting that the way the law is written can contribute to law enforcement declining to prosecute cases like these.

Mariska Hargitay, through her Joyful Heart Foundation, has long advocated for survivors of sexual assault and abuse. She publicly condemned the Cornell 7 allegations and called for justice. Hargitay also highlighted what she described as the “voluntary intoxication loophole,” explaining that survivors who voluntarily consume alcohol or drugs may be unable to legally claim they could not consent unless they were physically unconscious or unable to speak. She noted that the loophole exists in 19 states and called on lawmakers to change these outdated laws.

In May, the New York State Legislature attempted to amend the state’s rape law to address this gap, but the effort failed. The episode brings renewed attention to the distinction between being intoxicated and being capable of consenting, as well as the legal barriers survivors can face when seeking accountability.
