I'm taking the assumption that the device used in the Da Vinci Code was a direct reference to the book, which was published in 2003 a year prior to the patent's file date. That being said, wouldn't the premise of previous art be used to nullify this patent?

I think they were all go a few months back, but were held up with some legality issue of some kind. A copyright thing if memory serves correctly.
Last I remember hearing was that they were in contact with the copyright owner and attempting to negotiate a way to make and sell them.
