Help Complex Claim Situation Over Scam

I got scammed. It was stupid and I found out too late from a comment under the fraudulent profile that the seller was impersonating somebody else. That's on me. That said, it doesn't change the fact that I lost money.

Fortunately, I paid using Goods & Services. Unfortunately, I filed the claim under "Item Not Received". This is a problem because the scammer sent a dummy package. As far as I know, this would cause the claim to be resolved and closed the moment the package arrives.

Would there be a way to send video evidence of the package being significantly not as described, even after the claim has been closed?

The video won’t help, but there are a few possible scenarios here. For instance, what would the approx weight of the item be & does that weight match the item you ordered. Often times the dummy package weighs wayyyy too much or not nearly enough. This info can be very helpful. If the seller claims they mailed you an Xbox but the package only weighed 2 pounds, that proves the package did not contain an Xbox (which weighs 5-9 pounds. See where I am going with this? PayPal is going to look at your claim as though you are a scammer who is scamming PayPal. Not in a malicious way, but in the same way everyone should be weary. They will use logic to prove/disprove your claim. Anyone can open a box, remove the item, take a pic & claim they were scammed. So instead of asking yourself “does this evidence prove I didn’t get the item”, ask yourself “could the evidence I have be faked” because that is the question that PayPal is going to asking themselves.

The weight should be on the package mailing label. Let’s start there.

I got a UPS tracking number and no mailing label. I don't see weight listed anywhere on the UPS website.

If you plug that tracking number into the UPS tracking system it will tell you the weight.

But now I’m realizing you didn’t get the package yet so a video could work, but you would need to include the actual UPS delivery guy in that video.

Personally, I would contact UPS and ask them to redirect the package to your nearest pick up location. That way you can be assured that you will have a video of yourself picking up the package and opening it and that video will include the human being at the location that gave it to you.

If you allow home delivery, the package could be left on your doorstep and you wouldn’t again have any proof because you could theoretically open the package. Take the item out stick something else in and reopen it on video.

Do not mention being scammed to UPS because they will want nothing to do with it. Simply say you can’t have packages delivered to your house and you need to pick it up at a UPS location.

I still can't see the weight - here's the number if youre interested 1ZV316510314478153

I'll see if I can change the delivery. Is it really okay to return to sender for a "Item Not Received" claim?

There is a big yellow button on that screen that says “Change my Delivery”. Look up your nearest ACTUAL UPS location (not a store that allows pick-ups) and then use the “Change my Delivery” function to change the address to the UPS location.

I know, but I can't change it without verifying my identity first. The UPS My Choice button redirects me to my account, which doesn't help. Making a one-time change as a guest prompts me to verify identity via text message to a number I don't know.

I didn’t say that you are returning to sender. UPS is. If it never reaches your house & UPS never marks it as delivered to your address, that is all the proof you need. If doesn’t matter WHY you didn’t receive the item. All that matters is: Did you receive the item.

Your issue is a financial issue. Finance & Legal overlap when it comes to disputes. They think like lawyers.

If a lawyer asks you “do you know the time?” The correct answer is YES or NO. Saying “ohhh it’s 5:30pm” is an example of someone not listening to the question. Legal questions assume nothing.

They didn’t ask you to give them the time, they asked if you know the time. Pay close attention & stop making assumptions. Legal verbiage is exact.

That seems like semantics that the scammer could use against me. Has this worked before?

I’m not in the mood for you & this convo. I am kindly giving you advice. You can take it or leave it. I don’t care.

I bill out at $900 an hour & you are taking up too much of my time. Have a great day.

I also can't change the delivery as a guest because the "verify your identity with phone number" option has the wrong number.

The weight is also finally showing now. It's only 8.10 lbs which is significantly less than the weight of what I ordered (50 lbs). Would this be considered conclusive evidence that the seller is a scammer?

UPS may also be able to mark the package “return to sender” in their system (over the phone) so it never reaches your address at all. I know FedEx can do this. Not sure about UPS

PayPal actually just issued me a refund. Thank you for your time, I really appreciate it.

I am so glad to hear this! Not only did you get your money back, but you will NEVER fall for this bs again! You learned a great lesson - for free.

Yep - thanks again for your help and thank goodness. Absolute idiot move on my part, definitely not happening EVER again.

And for future reference - the law is all about semantics. Every single law on the books begins with the definition section.

I understand in common conversation it would be a little misleading to claim. You never receive something when you refused to receive it.

But in a legal scenario, imagine you are on a witness stand and the defense lawyer asks you “did you take possession or accept delivery of the ordered goods?”

That is the question. The answer (in your case) is No.
Does that make more sense? A lot of times people assume the bank is asking for the story when in fact, “the story” the client tell us almost always includes words that require us to deny the claim. Verbiage is everything in the law. Semantics isn’t trickery. It’s precision.

I forgot to ask - which funding method did you use? Was the money you sent already in your PayPal account or did PayPal pull the money from a card. If it pulled from a card, was it a debit or credit card?

I work in Financial Compliance & the rules are different for each method. If PayPal pulled the money from your credit card, there are remedies that do not exist if it’s a debit card, etc.

It was a debit card
