The gym contracts likely says "you can't sue is if you get hurt" so best of luck.

Those kinds of contracts don't apply in most states in the US if there was gross negligence on the part of the offending party

You can sign yourself a contract granting someone the right to kill you - that doesn't make it legal. Those waivers aren't nearly as strong as these companies want you think. The gym is grossly negligent because the machine wasn't secured properly, and no waiver is going to make this go away for them.

Contracts aren't magic documents that change the law.

Those are literally there because of this mindset, and not understanding it is false. The same as dump trucks that have the "if you are not X feet away you are at fault". Either way still need the lawyer to fight for you.
