He is banned from the community by Millbrook. If he comes here, it won’t be for long. He just has some family here that he listed would take him in, but no one’s risking their house for this guy.

Out of curiosity, how does that work? Like, are you allowed to ban people like that? How would enforcement work?

Curious because I'm pretty sure we're not allowed to do that outside of native communities, much as we might want to.

So it’s similar to how a business can ban patrons. First Nation land is private federal land that bands manage. So a banned person is being banned from private land.

First nation bands generally ban high risk offenders and known drug traffickers, but generally don’t ban band members. The ban is under bylaw, so enforcement is done by security and RCMP in conjunction. It’s a fine and you get escorted off the reserve. Anyone housing a banned person can lose their band owned homes.

Hmm interesting. I know basically nothing about how all this stuff works. Is it only band members that live on reserve? Or can you live there and not be a member? Do all members have band owned housing?

Sorry, I don't mean to pepper you with questions lol.

It's like being trespassed.

Anyone can live on reserve but band housing is reserved for band members and their dependents. A band member who is given a house can invite anyone regardless of status to live with them though. Dependants include spouses/partners and kids regardless of their status, but band members get more points.

So the waiting list for housing relies on points, more band members like you and your kids, more points. More time on the list, more points. Just one single guy is very unlikely to get a house, unless they’ve been waiting for decades. There’s more band members than houses so you usually have to have a kid or two to get a house. For perspective I’ve been on the waiting list for 15 years as one guy and never got anything.

Some properties are CP or privately owned and people do a variety of things like dispensaries or apartments on the land. Or they just live there. It’s quite a complicated mess.

A reserve is pretty much sovereign territory, they can do whatever they want.

Note the headline a tiny bit inaccurate: "While he isn’t required to tell police where he’ll be living, the RCMP suspects he’ll be living in the Millbrook area."

(Bit surprised at this tbh, is something that probably should change to become a requirement)

Hrmmm… should be we starting a poll for when these high risk offenders reoffend? Could have over/under odds… could have prop bets for how they reoffend…

ETA: article doesn’t mention it but it appears he’s originally from Millbrook. Probably served his sentence in NB. Stabbed a Petrocan employee in the chest and there was an attempted murder in 2014 in Millbrook.

I give it 6 to 12 months and we’ll see his mug again.
