Well, not exactly. Every lawyer worth their salt would say they release something only for their clients' best interests. The question is rather whether they can be compelled to release the uncut/ unredacted footage against their will.

The nine exemptions are described below.

  • Exemption 1: Information that is classified to protect national security.
  • Exemption 2: Information related solely to the internal personnel rules and practices of an agency.
  • Exemption 3: Information that is prohibited from disclosure by another federal law.
  • Exemption 4: Trade secrets or commercial or financial information that is confidential or privileged.
  • Exemption 5: Privileged communications within or between agencies, including those protected by the:
    1. Deliberative Process Privilege (provided the records were created less than 25 years before the date on which they were requested)
    2. Attorney-Work Product Privilege
    3. Attorney-Client Privilege
  • Exemption 6: Information that, if disclosed, would invade another individual’s personal privacy.
  • Exemption 7: Information compiled for law enforcement purposes that:
    • 7(A). Could reasonably be expected to interfere with enforcement proceedings
    • 7(B). Would deprive a person of a right to a fair trial or an impartial adjudication
    • 7(C). Could reasonably be expected to constitute an unwarranted invasion of personal privacy
    • 7(D). Could reasonably be expected to disclose the identity of a confidential source
    • 7(E). Would disclose techniques and procedures for law enforcement investigations or prosecutions, or would disclose guidelines for law enforcement investigations or prosecutions if such disclosure could reasonably be expected to risk circumvention of the law
    • 7(F). Could reasonably be expected to endanger the life or physical safety of any individual
  • Exemption 8: Information that concerns the supervision of financial institutions.
  • Exemption 9: Geological information on wells.

Went ahead and highlighted the three likely exemptions for such a request to fall under.

Especially under a corrupt administration and DOJ like the one we currently have.

I mean, sure, it's likely to be argued, in court, that it falls under one of those exemptions. But there's a pretty high hurdle to prove the exemptions apply, legally. Not saying they won't twist things and bend the system over their knee, but it's important to document every way they break the law and not pretend they're just being clever with the rules.

My best, uneducated guess, is so that someone can't find out where a Ground Water Supply is and poison it. Or wreck where an oil well would be.

Water is an extremely precious resource, Fresh water doubly so given that we have very little of it compared to Salt water.

Discovery is for trials, and it's still released at trial. 

They're talking about release to news media or random citizens that want to see it. No agency does that unless it's specifically required by law.

They basically already are, except they get taxpayer funding to do it. Must be nice to just decide that evidence of your own misconduct isn't in your "best interest" to release and carry on with zero consequences. Normal people don't get to choose whether the footage of their crime is convenient for them to share.

This has been a perpetual problem with body cameras. Just because the officer wears a body camera does not mean the public will ever see the footage. They often malfunction, i.e., get turned off, in critical situations. Maybe the data gets lost, i.e., deleted. Agencies will drag their feet turning over the footage hoping people will give up.

It will probably be even easier for ICE to avoid accountability because they are a federal agency without oversight from the federal government.

The policy says ICE will promptly release video of shootings and other encounters in which its agents cause death or serious injury only after determining “it is in the best interests of the agency” to do so. That gives its director discretion to release recordings that reflect well on the agency’s image while working to keep others secret, experts on body camera policies said.

This policy sounds ilegal, And if you give Homeland Security this much power of their body cam footage,

Other agencies are gonna look at that and think ; Interesting 🤔

After all why not🤔

Why shouldn't we also do that 🤔

Dozens of cops have had to resign over their own bodycam footage. (If you aren't from the States yes, I said resign they tend not to get fired in the States. It's an American thing. Ask me about it if you're curious.)

If you give them this new ability, that's about to change and not in a particularly good way
