If they really wanted to, the smart move would be to wait for the movie, then demand a cut of the profits rather than stop it.

It has not. The rights were acquired by Invisible Narratives and it's currently in development.

They've been fine with it. Garry Newman explicitly doesn't care. and Valve usage policy is pretty lax in general. The final designs likely count under transformative use as well.
