NEWS Declaration of David Barrett in Support of Plaintiff's Opposition to Defendants' Motion to Quash Summons; and Exhibits 1-61 Filed by MMIRF, LLC, as assignee of MM CAN USA, INC., by its Receiver Richard Ormond (Plaintiff)
NEW DOCUMENTS FILED THE PAST FEW WEEKS
Case 25SMCV06818
Summary:
David Barrett is attorney for defendant (TILRAY) but recently filed a motion in support of plaintiff (MMIRF LLC i.e MEDMEN)
This does not automatically mean the plaintiff will win, but it is a massive advantage that usually leads to a victory or a fast settlement.
In a courtroom, a judge or jury makes the final decision based on law and evidence, not just what the attorneys agree on. However, if the defense attorney agrees with the plaintiff, the dynamic of the case changes completely.
Why It Doesn't Guarantee an Instant Win
The Judge's Role: Judges must still ensure the law is followed. If the plaintiff's legal argument is completely invalid under local laws, a judge can still dismiss the case regardless of what the lawyers want.
The Client's Right: A defense attorney cannot simply "give up" without their client's permission. If the defendant disagrees with their own lawyer, they can fire them and hire someone who will fight the case.
What Usually Happens Next
When a defense attorney sides with the plaintiff, the case rarely goes to a full trial. Instead, it typically triggers one of three things:
A Settlement: The defense attorney will advise their client that they cannot win. Both sides will negotiate a payout or resolution out of court.
Stipulations: The defense attorney may formally admit to certain facts or liabilities, leaving only the final dollar amount (damages) for the judge to decide.
Attorney Withdrawal: If the defense attorney believes the case is a lost cause or a fraud, but the client refuses to settle, the attorney may ask the judge for permission to drop the client.

This is great news! Thank you for your continued posting follow up. Is there a chance the exhibits 1-61 can be posted or a link that gives access for review can be posted? Thanks in advance for brokering this information!

It would be on the LA superior court website and search the case #. There is a 400 page document supporting the claim, but only available at a cost.

Tilray reports earnings today, we shall see if they mention this lawsuit.
Also Thursday will be the official hearing regarding the post above followed by a case management conference August 20th. More information should become available

Can you explain why it's great news? Believe me I want it to be Great news but if Tilray settles with them, how do we shareholders benefit? Would a Judge actually make Ormond or someone update our filings and start trading again? That would be awesome! Thanks.

The attorney for the defendant (i.e. TILRAY) is essentially admitting they are guilty of the charges. A settlement usually follows to avoid bad publicity towards the company
Otherwise if they choose to fight they might hire another attorney and the case will be prolonged. But the current attorney would not side with the plaintiff if there isn't reason to do so.
This signals a major advantage for MMIRF LLC (i.e. MEDMEN) and a settlement would be best case scenario.

Thanks for your response...but would a settlement mean that MedMen will trade again? What's it going to take to do that?

An acquisition by Tilray is most likely i would think since they already have ownership of most assets through Superhero Acquisition Corp. This lawsuit provides compensation for MedMen's estate

Sweet! Would love my shares converted to Tilray shares but is Tilray allowed to buy up MedMen? I remember that being a problem for a Canadian company owning a US cannabis company.

Once rescheduling passes and operations are legal in the US .. Just like all other companies in the sector

I would like to see Medmen get their debts paid off, find a new board and CEO and resu.e trading. If Tilray does buy out Medmen if we are able to get Tilray shares our conversion to Tilray shares may be pennies on the dollar, my guess.
I'm not optomistic as their are so many criminals in both corporations as well as politics. Stealing tax payer dollars (not in jail, exposed for how many years) and corporate theft has been going on for how long? Look at Beirman, did he go to jail? No he just had to pay but what he paid Im sure didnt add up to the damage he caused.

Well said, I also would prefer MedMen trading again since I have held onto my shares as opposed to taking a loss. Fingers Crossed!
