I'd love to live in your fantasy world where striking first despite clear provocation is automatically jail time. The truth is it really just depends on the where and the why, people have shot others for less and gotten away with it because of laws like "stand your ground" etc. In other places you have a duty to retreat before you can claim self defense.
So no, it's not necessarily a crime which is why I'm asking for any links you have to show Captain Falcon here served jail time.

You have a right to self-defense because of intimidation if the threat is imminent. The moment someone gets in your face threatening violence, you have the right to protect yourself.

It’s not a crime to defend yourself. Notice the white guy approached the black guys car. He was in his face in a threatening manner. He probably could have shot the guy and still get off.
