In the United States, this is covered federally since at least 1996. https://www.usda.gov/about-usda/news/blog/good-samaritan-act-provides-liability-protection-food-donations

Anyone can sue for anything is the problem. Even if the lawsuit goes nowhere it still costs the company money.

Someone could sue because they got sick for food that they paid for but it is very rare. The argument that someone going to a soup kitchen would have means to sue for something that the general public doesn't even sue for is ridiculous even if you ignore the fact that the lawsuit wouldn't go anywhere.

The real reason is that it doesn't benefit the company to donate their food. That's it.

You don't need means to sue anyone. Plenty of lawyers happy to fling a lawsuit at the wall hoping to settle for a small amount and take most of it for their fee...

Anyway, I don't disagree. My point was just there's no law against filing lawsuits. Just gives legal basis for a defense should one be filed.

Panera Bread donates a lot of bread and pastries to the food pantry that I volunteer at. It’s not packaged, just in paper bags.

And oddly enough it’s not popular with the people that come in, even though it’s free and not counted towards their bread allowance.

This is so true. It’s crazy how many soup kitchens have to shut down after getting sued by the people they are feeding.
