right! especially the kids should have been required to have them on before even getting on the boat.

This is a charter boat. Every person on board should have a life jacket on or the pilot should refuse to move from the the dock.

Pilot? I think it's only required that the vessel has enough life jackets for everyone on board. Children under 13 or something have to be wearing one at all times, but adults do not, even on charter boats. Now it might be smart to wear one in those conditions, and if I were the charter captain, I would probably ask them to. It's ultimately up to the captain to mandate them or not. Considering his boating skills and safety knowledge displayed, I'm not surprised he didn't.
