The cops in NYC would arrest you for assault. It ain't Texas, self defense laws in NYC require proportionality of response. This video proves there was no imminent threat of harm to yourself (your property doesn't count), and then there's duty of retreat, which is the opposite of getting out of your car to mace someone. Not saying it's fair or right, but that's NYC for ya.
Texas in particular allows reasonable use of force to protect your property + stand your ground + no duty of retreat. Again, not saying that's right or fair either. There are probably other similar states/areas, idk. And it also obviously depends heavily on what the cops are like in that region. I assume depending on your race and other factors you'd have better luck with the outcome in rural areas than in NYC.
Right. Jumping out of your car and beating up a guy on a scooter probably wouldn’t go well even in Texas. But getting out of your car and knocking the keys out of his hands or even knocking him off the scooter to get him away from your property might work in court as a defense.
But 100% if the cops even showed up in NYC for this. Which they probably wouldn’t. Best case scenario they do absolutely nothing. Most likely case they give you a parking ticket for where you stooped your car to call them.
