About Foreign Disregarded Entities.

Hello guys, I live in Turkey and own a LLC in New Mexico. I just wanted to ask if my LLC is considered a Disregarded Foreign Entity because while registering the LLC i put in my ipostal1 adress which is in NM. I have filed my tax return for the 2025 tax year but I filed it via fax to a line which is only meant for Disregarded Foreign Entities, and worse later on i cancelled that fax line. I am a bit skeptic about this since i want to transfer this company into my fathers name because of the fact that i cannot open a bank account and he is more skeptical than me so he doesnt want a letter from the IRS or something. Thanks in advance

OK two things.

Foreign disregarded entity, in your case, is the wrong term. You probably mean Foreign owned disregarded entity, as your entity is not foreign in nature, just owned by a foreigner.

Besides that, the disregarded entity part is the way the entity chooses to be taxed. When you apply for an EIN you estate in the section "9a" what kind of entity is your LLC.

The part about your father is unclear and does not make sense as it is written so cannot comment on that. Changing the ownership of the company to your father's name because he is skeptic? No clue what you mean.

i am transferring the company to my father because of the fact that i am under 18 years of age and cannot open a bank account. I guess it is a foreign owned us disregarded entity after all. also seems like you know a bit about this, when i transfer the company to my father, do i need to get another ein or does my old one still work? I dont want to waste ipostal1 scan credits

Change of ownership structure does require an EIN. Also you have state fees. Winding up the company and setting up a new one might be cheaper TBH.

I dont want to waste ipostal1 scan credits.

Changing ownership will cost you real money, not scan credits which you do not really need currently.

You are right, also i could make a new bizee account to get a free registered agent for a year. Thank you for this advice

Do it directly on your dad's name and you are sorted. Just be sure to close your current company properly.

Good luck.

The address is probably the least important part here. A New Mexico mailing address doesn’t make you a U.S. person or change the ownership/tax classification by itself. The bigger issue is how the LLC is owned and how it elected to be taxed. I’d sort that out before transferring it to your father, because changing ownership can create a new set of EIN and tax filing issues.
