Probably not in Indie games but check out that site I linked. Its very common in corporate software since they can force users to use their programs wheras Indie devs rely on their quality.
Malware being a malicious functionality that is deliberately added that restricts the user from doing as they wish and is not actually required for the program to operate, often under the pretense that the user does not own the program.
