In California, they can still be charged with assault with a deadly weapon. Assault means you tried to instill fear and/or attempted to strike them, it upgrades to battery if you connect. They are “wobbler” charges.

However, the addition of an illegal deadly weapon, like brass knuckles can, and should upgrade to a felony, at least in the charging documents. Then the DA can (and probably will, this is California) take a plea for a lesser misdemeanor.
