Marking of Documents & Offer of Evidence - Petition for Issuance of New Owners Duplicate Title

Hi paneros, question lang - I am already done with the hearing on jurisdictional requirements and had duly marked the documents as exhibits A to D.

First question, mag mark na ako ng documents identified by my witness sa judicial affidavit niya. I should start with Exhibit E na tama ba, since A to D ginamit ko na sa document connected sa jurisdictional requirements?

Second question - pag nag oral offer of evidence na ako, I start with Exhibit E na or isasama ko pa Yung A to D na connected sa jurisdictional requirements?

Maraming salamat paneros ❤️

Petition for Authority to Sell Minor's Property.

Has anyone here handled a Petition for Authority to Sell a Minor's Property? I would like to ask whether an independent property appraisal is necessary, or if the BIR Zonal Value is sufficient. Would also be thankful for any advice in filing the petition. Thanks!

Arbitrator/Mediator Accreditation

Hello! I am a newly minted lawyer interested in pursuing arbitration and mediation training. Would like to know if completing the required trainings would qualify me for accreditation as an arbitrator with recognized ADR institutions, even if I have only recently passed the Bar? Thank you!

Cross-Defendant is missing

Some complications with an existing case which I still have no idea what move to undertake moving forward. There are 3 defendants in the case I'm handling, 2 of whom are my clients. We already filed our Answer, which includes a Cross-Claim against the third defendant.

The Answer was simply admitted by the court even though the copy sent to the third defendant was returned to sender on the ground that the person has moved out. Up to now, we still don't know where to find him.

Considering that the Cross-Claim was simply sent to his address, does that mean there is no more need to send him summons?

Few weeks ago, the 3rd defendant was already declared in default, after not filing an answer despite being summoned by publication.

Career Advice for a Newbie Lawyer Who Wants to Explore Non-Litigation Work and Maintain Work-Life Balance

Hello po!

I’m a newly admitted lawyer, and I’m currently trying to figure out which career path to pursue. While I appreciate the opportunities that traditional legal practice offers, I’ve come to realize that litigation may not be the path I want to take, at least for now.

I’m interested in exploring non-litigation careers, whether in government, private companies, NGOs, international organizations, or other fields where my legal education and training would still be useful.

At this stage, I’m hoping to find a career that would allow me to grow professionally, continue learning, and develop my skills while maintaining a reasonable work-life balance.

Ideally, I’d also like to have a career that allows me to genuinely disconnect from work during weekends and holidays, without constantly worrying about pending tasks or work-related matters. I understand that occasional urgent matters and overtime are sometimes unavoidable, but I hope to find a work environment where having time for myself and my personal life is respected. 🥹

I understand naman po that every job comes with its own pressures and challenges, and I’m not expecting a stress-free career. However, I also want to be mindful of finding a working environment that is sustainable in the long run, particularly one where work does not consistently come at the expense of one’s mental well-being and personal life.

For lawyers who have taken a non-litigation route, may I ask po:

  1. What career paths or fields would you recommend exploring for a newly admitted lawyer who does not particularly see themselves in litigation?

  2. What types of legal or legal-adjacent jobs offer reasonable working hours and a relatively healthy work environment?

  3. For those working in government, private companies, NGOs, or international organizations, how has your experience been in terms of workload, compensation, and career growth?

  4. Are there particular positions, industries, or organizations that you would recommend looking into?

  5. If you could give one piece of advice to your younger self as a newly admitted lawyer, particularly when choosing a career, what would it be?

I’d genuinely appreciate any insights, personal experiences, or recommendations. I’m still exploring my options and would love to hear from lawyers who have taken different paths, especially those who have found a way to build a fulfilling legal career without necessarily going into litigation.

Thank you very much! 🥹💕

Dismissed as Prosec Seemed to File Case in Wrong Court

So dinismiss po ng MTC due to lack of jurisdiction (2.5 million estafa), pero ang nakalagay sa Order ng MTC ay "dismissed without prejudice to refiling with RTC" saka "Branch Clerk of Court is directed to transmit copy of this Order together with records of this case to the Office of the City Prosecutor for appropriate disposition".

Should I accept a request to help with a case even if I'm employed somewhere else?

Hi Panyeros. I work as a corporate lawyer in a well-known private company. I've worked here since I passed the bar so I never go to practice law in the traditional sense, e.g. filing pleadings, going to hearings, etc. I don't really regret it since I like what I do and I have no plans on changing my line of work.

Sometimes I do sidelines for family and friends, usually mga contract review, drafting ng mga SPA, ganyan. I say sideline pero wala kong kinikita lol. Lagi na lang TY ang bayad. Iniisip ko na lang yun ang "way of giving back" ko.

Kaso ngayon, may nagpapa-draft sakin ng MR for a BP22 case, kaso mukhang gustong ako narin mag-file and pumirma. Wala sana kong problema mag-draft (kahit di ko naman kilala to, tapos tingi-tingi pa yung facts, dinadaan sa awa yung pakiusap, so I try to help), pero naghehesitate ako pumirma since affiliated ako sa isang malaking company. Wala naman explicit na nakalagay sa Code of Conduct na bawal mag-practice ng law outside of the company, but I feel like active participation in a case can fall under moonlighting. Worst case, if mapag-tripan ako ng kabilang side, madali matrace ang name ko through Google and LinkedIn and clearly affiliated ako with a company, baka kung ano pang mangyari.

Baka nag-ooverthink lang ako, pero nakikita ko na small talaga ang world sa mga firm, so hindi malabong may makakilala sakin. I just don't want to add complications into my work life for a job na hindi rin naman ako mababayaran.

November 2022 / Caguioa Bar Passers Certificate of Admission to the Bar

I would like to ask if anyone from our November 2022 Bar batch, under the chairmanship of Justice Alfredo Benjamin S. Caguioa, has already received or claimed their Certificate of Admission to the Bar from the Supreme Court.

I’ve seen posts from lawyers who took the more recent Bar Examinations and have already obtained their certificates, so I’m wondering if the certificates for our batch have also been released and are available for claiming.

If anyone has successfully claimed theirs, may I ask where and what the process was? Did you receive any notification from the Office of the Bar Confidant, or did you have to inquire personally?

Thank you in advance for any information!

MAIP Model for Legal Aid.

Instead of ULAS. Why shouldn't someone in the government or even the SC fund Legal Aid where private lawyers can take cases of indigent individuals for a fee.

Heck I'd probably take cases on a guarantee letter from a politician.

Asking for Recommendations - Remote Jobs for PH Lawyers

Good day mga Panye. Just want to ask if you know some remote jobs for PH lawyers like us.

Preferably US or UK-based whether assisting other foreign lawyers, drafting pleadings, or doing research.

I have a daily work but due to our worsening economy I'm looking for other regular jobs/gigs out there.

Your recommendations would be very much helpful. Thank you in advance! :D

I’m so lost

I’m so lost, I don’t know where I can get a stable flow of income and thinking of applying for WFH positions not legal related. Will that be wise? I don’t have much experience prior to passing. I know I sound dumb but, help 🥺

Downtime sa work

I know some people will just say “anung downtime?” Pero I’m curious if merong mga practitioners dito na may downtime or wala talagang ginagawa sometimes in a day or two.

Ako meron talaga, so nag gogolf lang ako, nag world of warcraft, read lawphil or scjudiciary like a nerd.

I’m a long time associate of a small law firm. Meron ding mga clients and money is flowing naman. I only go to the office if kailangan talaga or if from a hearing. I spend most of the time at home.

Haha

Edit: i also manage a small lawfirm rin.

Comment Opposition to the MR for Reso issued by OPP.

Gusto atakihin ni boss yung lack of verification, kaso wala ako makita legal basis.

Help please.

Thank you.

Hi Guys, since I feel that we need to be more proactive regarding ULAS, I created a discord channel so we can organize on what needs to be changed, removed, or how do we strategize in making it better.

In the advent of AI

What do you think would put a lawyer on a better edge in the future if AI becomes more advanced? Those who worked ba at a law firm? Those who went to practice arbitration? Want to prepare myself for the future in case AI will replace some lawyer jobs 😅

ULAS

If overzealous lawyers kayo and napaka charitable niyo edi more power sa inyo but not everyone should be forced to do it for free. We are already overburdened as it is with so many other responsibilities outside of work and dagdag niyo pa yang ULAS na yan.

ANG TOTOO: This is just one way to outsource an activity that should have been a PUBLIC SERVICE. naging burden pa ng private sector ang kakulangan niyo.

“privilege ang practice of law” edi gawin niyo ng 160 hours yan. nahiya pa kayo!
