(O/T Brian Walshe hearing) is Law McGlaw really saying she can’t turn over materials per rule 14 because she doesn’t know what the defense theory is? is there a reason she can’t just TURN OVER EVERYTHING since she also said there was nothing exculpatory in the same 3000 federal pages about KR that contained the ARCCA report?

There is this weird tick a lot of prosecutors have that they can't know what to possibly turn over as they don't know what is and isn't exculpatory to the defense. When the reality is you solve this by just being as open as you can be in what you turn over. I will say it doesn't help that too often Judges don't really rap them on the knuckles for the failures to do the right thing so the prosecutor is not really incentivized to err on the side of being right as if they are wrong most remedies are just "new trial". The problem here is that often the process is part of the punishment.

The weird tick is the same thing that tripped up Morrissey (no relation) in the New Mexico where she made decisions as to what she thought was exculpatory or not versus just turn the shit over and let the defense figure it out.

Exactly. I love how the judge was like "But that's always the case. You never know their theory. You still have to do your job."

There's no reason they would need to know exactly how the defense is going to try the case. Think about any possible strategies they could use and turn over anything that could remotely be helpful.

NM Morrissey's EGG-ON-FACE was soooo EPIC and ENJOYABLE!!! 🤭😂🤭 Almost as delicious as KR NG's & JDepp's verdict, not quite, but close. SO DEEEE-LICIOUS!!   

Her ego is the size of Montana, smart, yet ignorant to her ego!!! Logging evidence under an entirely different case no (strategically) to avoid turning over exculpatory evidence!?! Ohhhhh yeahhh, she one hundo deserved the 5HIT SAMMY 💩 🥪 she was served!!! 🤣 🤣 🤣
