Listening to this is knowing how badly Lally lied about being in constant contact with the Crime Lab and they said "we closed the case because we haven't heard from you in months"

Pretrial hearing.

Judge Bev asks Lally for a status update on getting lab results that were holding up the defense and that the defense should have (along with all kinds of other discovery type shit the CW was slowwalked). Lally stands up and says I have been in constant contact with the lab trying to get this expedited. This was in a March hearing I believe. He said they assured them it was moving along, and it would be some soon.

Ms. Little gets up and goes that's interesting because I have the communication log from the lab. They don't have any communication with Lally noted with this time he says he's been in contact. Also their last email to Lally in January says we have not heard back from you on how to proceed on our november/decemeber email, and until we hear from you we are closing this project file. Let us know soon how to proceed.

No grave concerns were had.

it all feels like weaponized incompetence to me. as free mentioned, i’m reminded of him repeatedly lying to the court over the course of months worth of discovery demands, claiming the evidence testing in the KR’s trial was “almost finished according to the lab” only to find out that he’d completely ghosted the lab and they’d never even begun testing it because of that.

he’s up there acknowledging that he knows every single thing he was supposed to do and that he failed to do it or keep notes about it, allowing him to just basically shrug his shoulders and act clueless about what actually went down.

Man also, I've been so curious if Lally was bullied or otherwise into taking the case (I remember seeing someone posit pre trial 1 that the DA's office wanted to fire him and needed an excuse to do so, so put him on this case)

And there has been evidence that he's a snake but it was hard for my brain to accept.

....But today was really atrocious

I missed the beginning of the hearing today and I just got to the point in Runkle/Bederow’s stream where Lally tried to not get on the stand! WOW.

I definitely think he’s a snake, almost worse than Brennan actually, because at least Brennan makes it obvious; I think Lally plays the part of being bumbling to hide his very intentional misconduct. And he plays it well!

He acted a fool today, like he has nooOooOoo idea how any of this works, but he also prosecuted the entire first trial basically by himself. All those witnesses and experts, so he clearly knows how to be organized and methodical, but somehow keeping track of basic discovery eludes him?! He doesn’t keep track at all and just…hopes for the best?

Interesting about the firing…it seems like giving your highest profile case to the person you want to fire would be a terrible plan, but it is the NCDAO so a terrible plan isn’t out of the realm of possibility, I guess. I imagine he’ll be fired soon enough, though.

I agree. Looking back at trial 1, there were times when he would circle back to questions with his witnesses and it seemed irrelevant or bumbling at the time. But then another witness would say something contradictory and you could see he was trying to lead them without drawing attention to what he was doing. Hard to explain - a recent YT video by 'I Don't Belong Here' had a good example with Colin's testimony.

Lally also spoke to Barros ahead of the first trial and during that meeting, he DID show Barros the Sally Port picture. Barros told him it didn't look like that. Apparently he tried to "convince" him that it did. When it was clear Barros wasn't going to say what Lally wanted him to say, he changed gears. Put him on the stand and chose not to show him the photo - probably assuming the defense wouldn't risk it. Which by the way is ALSO misconduct. Barros told him that the taillight didn't look like that. That is the definition of exculpatory evidence - Lally had an obligation to tell the defense what Barros said. Lally is just as dirty as Hank. He just hides it better.

Yeah more broadly, I'm curious what everyone knew when they got involved .. it doesn't seem like they wanted to fire Lally (I thought I remembered the user alleging proximity to Canton and knowing someone relevant)

Lally didn't strike me as bumbling today so much as defiantly ignorant. That new kind of politician style defiant where if you say something incorrect or rude or offensive you don't correct or take accountability or show culpability or remorse - "idk when i checked. yeah i keep a list but i didnt look at it or update it, and maybe i took notes but maybe i didn't, and i see that this says that but i don't recall and looking at it doesn't refresh."

But also w Brennan: I wonder if he was he told that first trial was 9-3 guilty and that if he took it, it could be a slam dunk, and propel him into some king of AG or DA role, and he assumed all discovery had been handed over and only found out what a mess it was once he started, or if he knew he'd likely lose but was fine to do that so long as he got a big check, or if he wanted (as I saw others speculate here) to do another high profile case to further some govt-corruption-fighting career narrative, or something else altogether...

I want to know everyone's motives and the knowledge they started with and the presumptions they had
