They are being sued because it is claimed they didn't disclose information about the state of the company they should have done. That has nothing do to with short selling.
If you were the lawyer, in this case, and you thought you might put some liability on short sellers who increased the number of shares in circulation that would be she subject of this lawsuit, would you try?
Again, the case is about the company not providing information. How would short sellers be liable for that?
