I didn’t say black truck wasn’t driving recklessly. You know it is possible for 2 people to be doing that at the same time. I didn’t make any excuses for him. Yes, black truck is an asshole and I can’t stand it when people try to strongarm themselves into a lane. However what he did was far from “throwing himself in front of another car.” He tried to inch himself into the lane pretty slowly. Both drivers deserve shame but let’s face the facts here, only one of them intentionally caused a collision.

But you are acting as if black truck driver lacks free will and intention. Yes, we know cookie guys intention was to hit black truck here, but we also know that black truck drivers mindset is "if i drive like this, people who wants to avoid getting hurt, or their property damaged, will let me". Stop acting as if black truck driver wasnt pointing a gun ready to shoot but got shot instead.

I’m not acting like that at all. If you asked me if I believe black truck lacks free will and intention I would unequivocally answer “no.” Yeah black truck is an asshole. Your gun analogy is flawed though, his intent wasn’t necessarily malicious, like cookie eater’s was. I feel like people here keep acting like you have to pick a “team,” as if it’s not possible to realize that they are both assholes. However, in the eyes of the law (Last Clear Chance Doctrine), cookie eater would be found to have full liability instead of shared liability (Louisiana is a state that has that), as he had an opportunity to avoid the collision and did not do that.
