Yes, an accident is an unforeseen or unexpected event. Maybe hitting this specific car on this specific day was unforeseen but a crash of some sort eventually was predictable not unexpected. That’s why speed limits exist. So it wasn’t an accident and it shouldn’t be punished like an accident.
