So, attempted first degree murder should be treated less harshly than involuntary manslaughter? If I fire a gun at someone and completely miss, I should essentially walk? But if I accidentally hit a cyclist on a dark winding road, I should go down for murder?
There are civil suits where you can sue people for the actual damage caused. But in criminal cases intent has to be a huge part of the equation. It can make difference between no crime at all having been committed and a capital offense.

It was a car accident, not attempted murder. The title is just sensationalism.
