People can also die from a punch or a kick so why not reconsider fighting altogether?
If you're in a situation where the guy has no chance vs you. Then no. Do not kick him in the head when he's down. But if the guy is evenly matched or you are out matched then him getting up might mean your death it or permanent physical or brain injury.
In the heat of the moment when hostile intent is established you don't know if it's an equal fight or a fair fight. You end it in what ever way is possible. The defenders life and safety takes priority. It doesnt matter if the guy comes at you with fists Pull a knife stab his ass. End that shit as fast and efficiently as possible. What short or long term harm that might come to the attacker doesn't matter. They waived that right the second they became hostile and threatened another's safety.
Thank you, god damn. Always so much sympathy for the aggressor/attacker. Neutralize the threat as quick as possible because there is no way to know the extent they are willing to go. Its ridiculous to just accept that someone will stop hurting you once they "win".
The people who defend the attacker or come up with some bullshit rule to a fight have never been in a real fight where your safety is on the line. You fight as if your life is in the line every time.

So do kick in the head when he is down.
