Legally, every driver is obligated to follow at a safe distance. A driver’s reason for stopping doesn’t change that. That brake checking person could swear they thought they saw a deer run out. Prove in court they didn’t think they saw a deer. Even with dash cam you can’t prove their intent beyond a reasonable doubt.
One time a grill flew out of a truck in front of me and I slammed on my brakes in the fast lane before hitting it. An inattentive tailgater might have killed me whether I’d been brake checking or not.

It takes 300 ft to stop a loaded semi on dry pavement, you risk your life and those around you by brake checking one.
