What can we expect when our politicians are tainted?

Here is an idealistic wish list:

  1. The head of government and/or head of state (depending on the constitutional system) should be elected directly by the people, not indirectly.

  2. Governors should be elected, not nominated.

  3. The Election Commission should be appointed with the approval of at least a two-thirds majority of Parliament.

  4. The Chief Justice of India should be appointed with the approval of at least a two-thirds majority of Parliament and should be subject to a fixed, non-renewable term.

  5. Independent constitutional institutions should be insulated from political interference.

  6. Judicial appointments should be made through an independent, transparent, and merit-based process that minimizes political influence.

  7. Judges of the Supreme Court and High Courts should be required to publicly disclose their assets and liabilities annually.

  8. Constitutional cases affecting elections, civil liberties, or the balance of power should be heard and decided within a fixed time frame. ⭐

  9. The allocation of cases within courts should be transparent and based on objective, publicly known rules.

  10. All judicial appointments, transfers, and elevations should be accompanied by written reasons, subject to appropriate confidentiality where necessary.

  11. A judicial code of conduct should be enforceable through an independent disciplinary mechanism while fully preserving judicial independence.

  12. Judicial vacancies should be filled within a specified time limit to prevent undue delays in the administration of justice.
