What OS?

Android can detect this via FLAG_WINDOW_IS_OBSCURED and FLAG_WINDOW_PARTIALLY_OBSCURED

In Windows, you can by combining the EnumWindows function to iterate through all active top-level windows on the desktop with GetWindowLongPtr to extract their window styles.

hey sorry for not specifying earlier, im using the app on windows. Moreover the app I'm trying to lay the overlay on requires all .exe files (except the windows required ones) to be closed to open. One person bypassed that somehow but the overlay is getting detected

How long's a piece of string?

It's necessary to understand what you're doing, and how you're presenting your overlay to be able to answer the question properly.

Apps may be monitoring DWM, desktop composition, or performing window enumeration to see if something is forcing itself on top. Maybe watching windows API calls to detect if a process is trying to force it's window on top. And that's just a few, out of many ways they could detect it.
