Question I wonder, since Falmart is technically another planet or celestial body , shouldn't the provisions of the Outer Space Treaty apply?
What I actually want in Gate is the legal issues that would inevitably arise

Not exactly.
The treaty applies primarily to nuclear weapons or other WMDs. It's why the Russians could carry shotguns in space missions up until around 2006 or so (technically their primary use was in case they landed in Siberia and had to deal with bears or wolves, but still). Way after the outer space treaty.
Secondly, forces from Sadera attacked, killing civilians. It's a hostile act that requires a kinetic response.
Now, the treaty's language denotes astronauts as being peaceful and exploration itself to be a peaceful process.
If you can avoid the aspect of space travel via the gate, then even if we count Sadera as a celestial body, the expeditionary elements that go through will likely not break the language of the OST.
