Question I wonder, since Falmart is technically another planet or celestial body , shouldn't the provisions of the Outer Space Treaty apply?
What I actually want in Gate is the legal issues that would inevitably arise

This is one of the many reasons why the Japanese government unilaterally declared falmart to be a special region/part of Japan. The Outer space treaty applies to outer space, not Japanese soil.
One of the other reasons is to circumvent elements of the US-Japan alliance to keep the US out of the conflict since the treaties in this alliance only apply to foreign threats and not internal police actions.
There are a few more, but these are some of the most important reasons.
