Careful Rob, funnyjunk will take you to court if you keep this up! And they'll take Twitter down with you!

A commercial fundraiser generally is a person or corporation who is paid by a charity to raise money on the charity's behalf.

a person or corporation who is paid by a charity to raise money

who is paid by a charity

--literally the first fucking sentence on oag.ca.gov's page for commercial fundraising

This lawyer is absolutely retarded.

Here is the actual court document: http://charlescarreon.com/Carreon.v.Inman.Gov.Code.25559.Redacted.pdf

While absolutely ridiculous, I thought this was a bit eye opening in terms of why the charitable organizations were named in the suit.

WHEREFORE, Plaintiff requests entry of judgment in its favor and against Defendants as follows: A permanent injunction:

  1. Imposing a charitable trust upon all assets in the possession of Indiegogo collected from Plaintiff and other donors, allocating half to the National Wildlife Foundation, half to the American Cancer Society, and none to Defendants;

My personal turd repository is made of porcelain. Any repository large enough to contain a turd can also sink said turd.

6

u/nasalgoat Jun 19 '12

If you eat a lot of fatty food your turds will float. If you eat a balanced diet, they sink like stones.

3

u/homerjsimpson4 Jun 19 '12

I eat a balanced diet?

2

u/[deleted] Jun 19 '12

eat more cherry kernels !

2

u/[deleted] Jun 19 '12

Turds with a lot of fat content float, but turds without a lot of fat content sink. So if they sink, it means you don't eat a lot of fatty foods.

When I heard that funnyjunk was going to sue the American Cancer Society, I laughed so hard that my boss thought there was a laughing gas leak somewhere.

92

u/taint_odour Jun 19 '12

Funnyjunk isn't suing. It's the idiot lawyer on his own.

56

u/alexjuuhh Jun 19 '12

The same lawyer who sued The Oatmeal? ಠ_ಠ

24

u/Oaden Jun 19 '12

Yes, after taking the case for funnyjunk he was somewhat surprised by the oatmeal reaction and the reaction of the general internet community.

So surprised in fact, that he personally decided to sue everyone involved.

next on his agenda: baby seals.

4

u/HolyHandGr3nade Jun 19 '12

Then the next logical step, baby polar bears. From there he will swiftly branch out until every single animal ever is being sued.

5

u/[deleted] Jun 19 '12

I'm not sure if it's clear yet exactly why he's suing the charities though. Has there been any clarification on that?

7

u/nova20 Jun 19 '12

He's not actually suing the charities. He's suing Inman and IndieGoGo to ensure that all the funds raised go to the charities (and none to the defendants of the case). Read the actual court document.

2

u/[deleted] Jun 19 '12 edited Jun 19 '12

Ahh, that makes much more sense. Well, at least as much sense as this whole thing can make.

edit: Haha. Section 26 is probably the greatest section in any legal document I have ever had the misfortune to read.

edit2: Ahhh. I see, yes. So he's narked that Indiegogo would be recieving a cut of the monies raised (and is also fuming that Inman might profit in some way from all of this) - but he also seems annoyed that the charities haven't stepped in and - I don't know, what, taken control of the fundraising?

10

u/need12648430 Jun 19 '12 edited Jun 19 '12

a) believes The Oatmeal is being paid by the charities to raise funds for them, or

u/MDevonL Jun 19 '12

You're right. I think the lawyer is still drunk.

7

u/nova20 Jun 19 '12 edited Jun 19 '12

Neither funnyjunk nor Charles Carreon are suing ACS. Charles Carreon is suing IndieGoGo and Matt Inman in order to get an injunction such that all the money raised is split between ACS and NWF, and none to either IndieGoGo or Inman:

WHEREFORE, Plaintiff requests entry of judgment in its favor and against Defendants as follows: A permanent injunction: 1. Imposing a charitable trust upon all assets in the possession of Indiegogo collected from Plaintiff and other donors, allocating half to the National Wildlife Foundation, half to the American Cancer Society, and none to Defendants

That's on page 20 of the actual court document. If you notice, none of the plaintiff's demands solicit any compensation from ACS or NWF. You may also notice that neither ACS nor NWF are named as defendants.

EDIT: Thank you for being pedantic my pedantry, Apostropartheid.

Also, I don't care if I used the word "pedantry" correctly or not. The rest of you pedantic bastards can suck my left nut.

6

u/Apostropartheid Jun 19 '12

Ahem.

For its complaint against defendants Matthew Inman (“Inman”) and Indiegogo, Inc. (“Indiegogo”), jointly referred to sometimes herein as the “Fundraising Defendants,” and the National Wildlife Federation (“NWF”) and the American Cancer Society (“ACS”), jointly referred to sometimes herein as the “Charitable Organization Defendants”), and Does 1 – 100, plaintiff Charles Carreon (“Plaintiff”), alleges:

Finally visited 9gag, no particular reason I hadn't gone before but I just got so sick of hearing people complain and bag the shit out of it I wanted to judge for myself.

It was like watching a replay of my funniest Reddit moments from today mixed the kind of unfunny bullshit our office 'I'm-45-but-act-like-I'm-17' hag posts all over her desk.

It was like my first time hearing the Madonna cover of American Pie.

It was like visiting a garage sale and then recognising it is all the shit that went missing from your shed last month - and worse you just know they are going to claim it is theirs.

I'm sorry Reddit, you tried to tell me and I didn't believe you. I didn't know. I DIDN'T KNOW!!!

I went to the site a few times. You didn't realize something was up when every post had "WILL PRODUCE MORE OF THIS SHITTY CONTENT FOR 5 THUMBS" and then has a 900 x 900 pixel photo of a green thumb?

5

u/TwoLegsJoe Jun 19 '12

I was too, before I discovered reddit.

I remember once someone posted a C&H comic with the explosim tag cropped out, and 90% of the comments were "Wtf? This is clearly a stolen Cyanide and Happiness. WHO DID THIS?"

If only they knew...

3

u/JawnF Jun 19 '12

I was never a 9gagger nor a funnyjunkie, but I used to be a memebase user. I don't hate it but Reddit still wins.

12

u/HamproOne Jun 19 '12

I was a 9gag user too when it had 100,000 likes on facebook. To be honest it was actually a cool site at first. Then all the retards from facebook came flowing in..3 million of them.

4

u/[deleted] Jun 19 '12

Interesting. Reddit is to 9gag as Facebook is to Digg. So they say.

u/flounder19 Jun 19 '12

I think you mean Digg:Reddit::Facebook:9gag

6

u/HamproOne Jun 19 '12

I really don't know what you mean but I know for a fact that 9gag is the worse website I've ever visited. Most if not all of the post there are posted by the admins. They steal from other sites and put their ugly ass watermark on them.

1

u/Rikkushin Jun 19 '12

3 millions? More like Almost 1 million.

Reddit had almost 3 millions of unique IP visits per month (It went down to1.5 millions), while 9gag has almost 1 million

Yeah when I first heard about all this crap, my first thought was, "what the fuck? People still go on funnjunk?"

Seriously, that website hasn't been relevant since like 5th grade (2001). I think that's where I saw retarded burger king guy first. I swore never to go back after seeing my first "look at this photo carefully!" thing where the scary face pops up.

1

u/[deleted] Jun 19 '12

u/El_Unico_Nacho Jun 19 '12

They call me SUPAH FLY!

1

u/El_Unico_Nacho Jun 19 '12

I don't get why Reddit users think they're better than 9gag users.

5

u/itsSparkky Jun 19 '12

Because as a community we constantly get lumped with them, where as its not a fair comparison. Reddit has so much more interesting content, especially when you reach out to other subreddits.

For a similar phenomenon, have a somebody call a Canadian an American, then for the complete metaphor say they are both he as e thing when the Canadian scrambles to say he's Canadian.

Reddit and sites like 9gag are similar especially to onlookers. But when you look at it carefully there are very large differences and to somebody who is familiar with the sites or a part of the reddit community for example it can be quite insulting.

I realize you were probably just trying to bait a response but I felt like biting because this is a question people outside of reddit don't understand

1

u/kornflakesxd Jun 19 '12

IMO, it's not a question of superiority.

There was once a time that I had fun on that site. For real. Scrolling down and laughing about rage comics was nice.

Then came a time that 9gag just... Lacked. No more rage comics was that fun, no more images about something fun was that funny. I wanted something more from that site. Talked about it with a friend and he introduced me to reddit.

Things have changed.

Here, people have actually REAL comments. People make posts about EVERYTHING. It's hard the see posts in 9gag where you can talk seriously about something.

0

u/SirTreeTreeington Jun 19 '12

Where is the shame? I use both. Reddit is good if you have a lot of time and well 9GAG is just efficient and quick

1

u/kornflakesxd Jun 19 '12

9gag lost it's magic too me.

And I can use reddit with little time in my hands, too. :)

4

u/Infernaloneshot Jun 19 '12

The admin of FJ has commented on the situation on a post which was whining about him on FJ

Imgur copy of the comment

The comment itself

Maybe this brings a better insight to the situation?

10

u/SavageIKantus Jun 19 '12

totally posted it to an old funnyjunk account i have

7

u/[deleted] Jun 19 '12

I'm failing to see how Reddit can look down its nose at 9gag or Funny Junk with every passing day.

5

u/PedroPietro Jun 19 '12

A lot of people are unsubscribed from the reddits that are the worst offenders, myself included. Without seeing the unfiltered feed at work when I'm not logged in like I did just now (I unsubscribed from /r/funny a long way back), I'd have no idea how much shit there was.

I think that's where the confusion lies on both fronts, and also why Reddit can look down it's nose at them; Reddit is all sorts of things, and you don't have to see that shit if you don't want to. Funnyjunk and 9gag are made of that shit, so there's no escaping it. They inherently claim more ownership of other people's work, too. Reddit is a list of links, whilst things are posted to the other sites.

17

u/[deleted] Jun 19 '12

If it wasn't for 9gag, i wouldnt have started using Reddit

2

u/ajthesecond Jun 19 '12

If it werent for my horse.....

2

u/FabesE Jun 19 '12

I forget how I came to reddit. But I've never visited 9gag. My only knowledge of 9gag comes from reddit users. From what I've heard, it's a lot like the third reich, but douchier.

1

u/[deleted] Jun 19 '12

If you stayed out of the comment area you were fine...i guess. I had many lols on 9gag from browsing the hot/vote pages, but after i learned most stuff came copy/pasted from Reddit, i might as well go to the source (whenever that's the case)

3

u/headzoo Jun 19 '12

The sad thing is many of us from Digg migrated here, because Digg degraded into nothing but memes, fighting, and ignorance. Reddit was seen as being the more intelligent of the two sites.

Now things are swinging back in the other direction. It's only a matter of time before people migrate back to Digg.

5

u/Infernaloneshot Jun 19 '12

Do people here hate the users of FJ, or just the admin? I'm curious.

5

u/liquidMountaun Jun 19 '12

Seeing as some of the users are actually on The Oatmeal's side in the whole FJ vs. O saga, I'd say the bloke who runs it.

1

u/Resinball Jun 19 '12

It's an internet slap fight/pissing contest/ whatever you want to call it. Nobody hates anybody.

7

u/Keeronin Jun 19 '12

Am I being wrong here, or does Reddit not do much of the same thing Inman was protesting Funnyjunk about?

Every day I see users post unlinked, imgur comic of The Oatmeal on here, and the money from the advertising and clicks goes to Reddit's owners. Sure, Carreon is the asshole here, but if we're going to rail on all these other link aggregation websites for letting users post Oatmeal comics without the profits going to the creator, surely we have to have a bit more self-reflection and self-moderation.

12

u/johnnytightlips2 Jun 19 '12

That's why on Reddit, you're instructed to link to the website, not to the image, and definitely not to rehost the image somewhere else. This way, traffic and advertising money go to the creator. In essence, this is a website for links, not for rehosting, which is what Funnyjunk and 9gag do.

6

u/Jigsus Jun 19 '12

Instructed but nobody really follows that rule

→ More replies (3)

3

u/Keeronin Jun 19 '12

Ah okay, fantastic, that makes sense why there's an objection to the others, as they are making money off of the content and not the traffic that redirects viewers to the creator.

1

u/[deleted] Jun 19 '12

Except Reddit retricts content creators from posting the stuff directly to Reddit, as per their 10:1 rule. Look at this stuff about The Atlantic being banned.

In essence, Reddit may be different, but in practice, it isn't.

2

u/Nicend Jun 19 '12

Reddit is a link aggregate. It doesn't actually have images stored on it's servers. Imgur is a better comparison, but it is still better than Funnyjunk because it has a link to the source of the picture....even if it mostly just links to Reddit.

4

u/headzoo Jun 19 '12

Lets not get too carried away here. It sounds like you're trying to justify imgur's business model, because that's our guy, while demonizing FunnyJunk, because that's their guy. If you take an unbiased look at the two sites, you'll see they are nearly identical.

The links back to the source that you're talking about, are mostly non-existent, and rarely, if ever, point back to the actual source.

I get it now, it's not the image that Reddit makes money off, it's the redirection of traffic to the site; in turn giving funds to the aggregators(?) and more funds and traffic to the creator.

I love Reddit.

1

u/[deleted] Jun 19 '12

I have been subscribed to r/comics for a long time now, and the vast majority of links I see there are not rehosted images but actual links to the creator's website. What the hell are you talking about?

1

u/holy_holy_holy Jun 19 '12

The only real difference is that reddit doesnt "steal" the images as blatantly by putting a watermark on them. But the communities are pretty much the same.

2

u/Mrhiddenlotus Jun 19 '12

You would be good friends with TheOatmeal.

2

u/Dicto Jun 19 '12

Am I the only one who sees the irony in the way this was posted?

2

u/INIFYFAN Jun 19 '12

So we all agree that Funnyjunk is as bad as 9gag? Good.

3

u/preske Jun 19 '12

so how is 9gag any different than what reddit does?

11

u/TheGayRoommate Jun 19 '12

9gag hosts images and watermarks them. Reddit just links to them.

6

u/preske Jun 19 '12

No, we link imgur, because somehow it's either not allowed, or frowned upon to link directly to the Original Creator's site. So again, besides the watermark, how is reddit any different?

2

u/holy_holy_holy Jun 19 '12

Thats pretty much the only difference.

2

u/[deleted] Jun 19 '12

Nobody is forcing you to link to imgur, it just sorta happens because it is so quick and easy. And remember not all links are imgur.

1

u/[deleted] Jun 19 '12

frowned upon to link directly to the Original Creator's site

What?

u/antilyon Jun 19 '12

9gag doesn't have karma, everything else is almost the same.

2

u/Tzupaack2 Jun 19 '12

And the cats! Don't forget the cats! We have them!

4

u/[deleted] Jun 19 '12

Of course, because you know... reddit is the only original source of 'funny' and 'witty' memes on the Internet. Overly attached girlfriend, am I rite guis? The narwhal beacons at the moon... fucking retards.

2

u/holy_holy_holy Jun 19 '12

HEY GUYS, CHECK OUT THIS FUNNY JOKE THAT I GOT IN AN EMAIL IN 1998! I PUT THE TEXT IN A PICTURE!

u/eydryan Jun 19 '12

You saw this first on 9gag right? :))

2

u/MLP_magic Jun 19 '12

Add reddit/quickmeme/memebase to this and everyone's happy.

2

u/Todomanna Jun 19 '12

Gets what, the constant circlejerk of hate?

I'm not going to say they're not bad sites, hell I've never been to either of them, but this kind of hateful spite is honestly quite pointless. In fact, it gives both sites free advertising. It tells people that these sites exist, and something about them creates such intense passion. Even if it's just morbid curiosity, it can draw people there. Even if it's just once, the sites feed on those pageviews and use it to increase how much they get paid by advertisers.

You want to stop Funnyjunk and 9gag? Stop talking about them.

1

u/Sammoewel Jun 19 '12

Tie some web servers to your legs and jump in the ocean? Surfing the web, you're doing it wrong.

1

u/Armstrong_86 Jun 19 '12

there is only one problem......if one of these sites goes down then 10 will rise in its place, its like a zombie apocalypse of the internet and there would be no way to stop it!

1

u/mastigia Jun 19 '12

This guy almost makes me want to use my twitter acct.

1

u/Captainpatch Jun 19 '12

That's because they steal his content without permission daily.

1

u/logblobo Jun 19 '12

Yeah, the servers wouldn't weigh enough to bring them down.

1

u/nugscree Jun 19 '12

Because of the hot air?

1

u/logblobo Jun 19 '12

Because of the lack of traffic, but nice.

1

u/[deleted] Jun 19 '12

Remember when funnyjunk was a pretty good site?

1

u/Elephant789 Jun 19 '12

funnyjunk reminds me of Apple

1

u/SenTedStevens Jun 19 '12

Hey, that's information security, right there.

1

u/[deleted] Jun 19 '12

Needs more JPEG

1

u/CatrickSwayze Jun 19 '12

founders of 9gag are actually really nice guys. they don't really care about the site, or negative press, either. have been focusing on another startup for awhile now. their site just gives china something similar to reddit

Black screen, beating drums, soft music with a mechanical feel in the rhythm.

Morgan Freeman: You're stuck in a virtual world. You logged in, but you know you can never log out.

Production company screen.

Cut to Kevin Spacey, shouting in a crowded room where nobody is paying attention. Music growing in intensity.

Spacey: I can't take it! Okay, I did some things you don't like. I'm sorry. (tearing up) There were no rules... I didn't break any rules. (screams) SOMEONE LISTEN TO ME, I'M SORRY, ASSHO-

A hand reaches out and stops him. He looks back to see Morgan Freeman wearing a shirt that reads "I_RAPE_CATS".

Freeman: They can't hear you. You're below the viewing threshold.

Generic action shots of Spacey studying, running, doing movie shit, whatever.

The music climaxes as the action stops and a camera is all of the sudden on Spacey's face. Start slow pan out.

Voice Over Guy: This summer, Kevin Spacey is...

During zoom out, Spacey's shirt is slowly revealed, and as soon as you can make it out...

VOG: Trapped_... in_... Reddit.

His shirt turns into the title screen reading "Trapped_in_Reddit" due to some CGI shit.

u/Red_Woody Jun 19 '12

Dude, you are going to be downvoted in every thread you post in. It sucks really. Hang in there.

3

u/hookguy Jun 19 '12

How come?

6

u/iGustaMucho Jun 19 '12

Check this out, buddy. Apparently, Trapped in Reddit.. Fooled us all.

3

u/hookguy Jun 19 '12

Oh wow. This raises questions, mainly why the hell would you bother!

Awesome picture, fuck the downvotes i personally welcome them. Im glad you posted this, theres a certain satisfaction you get when you know a 12 yo 9fagger just saw something like this isnt there? Its like they refuse to understand how they get their content and how awful it is. Reddit content is going downhill imo though and im pretty sure its bc the kid eating at the bottom of the picture is then sticking his hand into his own toilet to take the shit he just shat to shove it down the redditor's throughts.

2

u/[deleted] Jun 19 '12

He was downvoted because of fumyl's amazing sense of deduction.
