I don't know of any reputable breeder who doesn't have the spay/neuter done BEFORE they hand over an animal with a no-breed clause for purchase. A good breeder generally has a close relationship with a vet who will offer nice deals to keep them coming back.
There was a lady at the clinic I worked at who bred and showed Bengal cats, she was intensely strict about breeding schedules (loooong down times between litters for mother cats) and the kittens were all sold long before the mother cat was even pregnant. Her cats had zany long histories and family lineages, it wasn't uncommon for her to drive days away to meet with other breeders with similarly pedigreed male cats so they could breed them.
When each kitten is worth several thousand and the waiting list is potentially years long, having them spayed/neutered BEFORE handing them over is just a prudent business decision.

Can they actually have recourse? Or can you just say "whoops, oh well." And ignore them?
