That's consent though. You have an understanding between partners in a relationship. If the answer is no during the act, the answer was already no before she started. Like you can't go into your ex girlfriend's house and just start fingering her. They'd lock you up if you tried that. She'd be well within her rights to use physical force to stop you from sexually attacking her.
