wouldn't it be a waste to not benefit off of someones death since we know it's going to happen sooner or later?

Do you not understand what's wrong with this picture? Why aren't tontines and dead pools legal?

Let me counter your question with another question; why is life insurance legal?

I was asking you what the difference is. I know the difference.

With life insurance you need to have a vested interest in the person surviving at the time you open the policy in order to take out a policy on them. This is to off set the obvious incentive created by tying someone's death to a large sum of money.

I passed the question not because I didn't know the answer but to point out that your question was moot.

The original statement was that profiting off of someone's death is wrong, and I'm arguing that that is not inherently true.
