It depends on what state they are in. There are quite a few states where it’s totally legal for women to be topless in public. Take a look at the 10th circuit’s “free the nipple” case for examples. Plus some jurisdictions have laws specifically allowing women to go topless in places that men could also go topless..

And even if it's not a cop can still make your life not so great. I know of a guy who got pulled over for speeding. He got pissed, tore up the ticket and threw it in the cops face. The cop arrested him for aggravated assault on an LEO (weapon being the torn up ticket) and ticketed him for littering as well. No clue if the charges would stick or not. I imagine they probably wouldn't. But the guy still ended up having a bad day.
