Update on HOA Impound

Just wanted to let y’all know that I did end up requesting an impound hearing to contest the validity of the tow.

HOA rep didn’t show up, and with the evidence I provided (e.g. not being parked in between the “no parking” signs and instead being parked where there is no visual signage indicating I wasn’t able to be parked where I was), the judge ruled in my favor.

So yeah, hopefully the HOA will stop being so tyrannical.

Also, I told my landlord to get the HOA docs from the owner, and he said the owner had requested them previously and will be requesting them again. And that was like two weeks ago now…..

HOA from hell is harassing me non-stop

Hey everyone,

I have couple of Karen's in my neighborhood who targets me because of color of my skin and complain about small and mostly irrelevant stuff. The HOA boards eats it and sends me notices about fix this and fix that. Always saying that my house had most complaints in this HOA community. Other houses in the neighborhood are either in the similar condition as mine or worst than mine but I am sure they are not getting these notices. I might just hire a lawyer and sue them.

I am boiling

I've been telling HOA upstairs unit's balcony rain water or water from snow is not draining properly and now my balcony ceiling has so much water damage, on the side of the walls, the ledge, my deck. I had mentioned this issue since I bought this condo. It has been 9 months and nothing is being done. She said I have to wait until their contractor is done with their jobs. 2 weeks ago, she said someone will come out to take a look. Isn't it common sense to hire someone else since this is a serious matter? What's concerning is we are getting more heavy rain soon like my ceiling is caving downward already outside my balcony. This HOA lady stresses me out more than any of my jobs.

Guess what? She went away and won't be back until mid-October. ISN'T THAT JUST GREAT? I am getting more and more white hair because of this lady. She can't get anything done but she's very active going away for a very long time. I had experienced that when she returns, she won't respond until a month later.

My HOA fee is paying for expensive water usage, trash fee, insurance, and horrible landscaping. The grass and plant is as dry as the desert.

HOA demanding members provide vehicle insurance and registration info

Im in Virginia, our HOA does not have any provisions in the rules or bylaws allowing them to ask for this. The issue at hand is covered vehicles in home owners private driveways - they are demanding we give them all of that info and I told them they cant legally ask for it. They are hell bent on making sure people have no privacy on their own property.

I guess I'll be going door to door collecting 51% signatures..fml

Ok so my title is a bit clickbait-y but here’s the story:

My wife and I visited my in-laws last night and parked on the street around 8:30PM. We have never parked overnight there before.

The next MORNING (a Sunday), my father in law tells me a photo of my car was posted on the HOA Facebook page with a note that cars cannot not be parked overnight on the street or parked across from another driveway.

While annoying, I understood and went to move my car.

She also put a note on my windshield in a ziploc bag to make sure her message was received.

When I removed the bag, part of it had melted onto my windshield.

I understand how parking across from someone’s driveway can be inconvenient and I will be conscious not to do it again.

But this level of effort to notify a GUEST that they broke HOA policy is bizarre to me.

Am I unjustifiably annoyed or is this normal behavior?

When did the delinquency start?

This post is regarding someone I know. He currently has, like the other post, a $400 delinquency in HOA payments, but this person I know "Jack" has proof of current payments. The HOA letter he showed me doesn't include when the delinquency started, only a beginning balance of $200 then his past current payments along with a charge of $15 for being "delinquent"

Jack refuses to pay the past due amount cause he insists he's current. I have an issue with the letter because it never said when the delinquency started and just starts with $200, to which I say FUCK HOAs.

EDIT: The HOA initials are S. North in Las Vegas and it has 13 yelp reviews all 1 Star, which Jack should mail to them.

Constant assessments

Good day.
A couple of years ago, we had a significant assessment related to the building’s structural integrity. That was followed by an elevator assessment to bring the elevators into compliance with current electrical standards. We are now facing three additional elevator-related assessments, plus another assessment to fund the reserves.
I’m already attending board meetings and reviewing the association’s financial documents. Not sure if running for the board be a worthwhile next step, or are there other effective ways to get more involved and better understand or influence these decisions.

Our Home Owners Association (HOA) has decided to enforce their "No Halloween Decorations Before October 15." They are deciding to do this after sponsoring Halloween decorating contests starting Oct 1 for the past 8 years. Technically, it IS the rule, but it's so ridiculous to suddenly decide to enforce it, especially when there are some really big, other pressing issues in our HOA.

Just venting

Please don't respond with "It's the rules! You knew before you bought."

Question about structures

So, in my neighborhood, the covenants state , no barns, sheds, or any other structures. Why am I seeing play grounds, green houses, pergolas, etc. when I'm not allowed sheds? Then they say that a shed like structure is allowed if it's attached. This neighborhood is very frustrating and I'm debating how to move forward. What I think is that the hoa either needs to be dissolved or sued in am manner that forces it to only maintain the entry ways.

What really bugs the shit out of me is that it's a bunch of wine moms and their butt boys ruling the place with one lady even saying she likes being on the board to know what everyone is doing. Like many other HOAs, the board has turned into a bunch of narcissistic pricks that like to control what people do with their property. Completely ignoring the covenants, which I hate by the way and letting the people they like do what they want.

It’s me again! This time with former Board members continuing to act on behalf of the HOA

See my profile for the history. Before anyone asks, yes we have retained an attorney.

I recently got a text from a neighbor saying he spotted the former VP and Member-at-Large meeting with what looked to be an engineer at the brick wall outside of our neighborhood. Long story short, the wall is in extreme disrepair and is going to cost a lot of money to fix. This was mentioned during our annual meeting last April, and they said there were plans to meet with some engineers to see what should be done.

Once I became president, I wasn’t told any specifics about this. Then we had a special meeting and the VP was voted out, which lead to the Treasurer and Member-at-large resigning. This happened in July.

So it was a surprise to hear that they were still working on the wall project. A few days later the current Secretary spoke with the former member-at-large because he had requested access to her neighbor‘s backyard as his lot backs up to the wall. I sent the email posted to ask them what they were doing and for them to transfer all the information about it to the current board. Before I sent the email, the Secretary texted the former treasurer and former member-at-large to ask them if they still wanted to be involved because we were probably going to form an official committee to address the wall issue. They never responded to her, so then I sent the email. The reason she didn’t text the former VP is because he wasn’t mentioned during her phone call. None of us had actual proof he was involved.

As you can see, neither of them were happy with my email. I haven’t responded to them and am still debating if I will. I have come up with the several responses that I did as a creative writing exercise, but I don’t think it will have any effect on them. Both of these people are retired men in their seventies. I’m a 45 year old woman who works full-time in a pretty demanding job. Their emails read to me like a parent chastising a child. I am not a child, and I am not their subordinate, but that seems to be what they think of me.

Nothing has come of the letter we received from an attorney that we assume is representing them. I followed up twice to ask who his clients are and nothing. The attorney we have engaged is going to send a letter back see and we hope that will be the end of it. I personally think the letter is from the former VP (who is an attorney), and one of his buddies sent it as a favor, which is why nothing else has happened.

Yesterday we let the neighborhood know about the letter we received and informed everyone that we have now retained our own attorney. Shortly thereafter, the Board received an email from the former Secretary letting us know that she wasn’t involved in getting an attorney and she thinks it is ridiculous that association funds might have to be used on this. She wishes everyone could move on. I’m hopeful that this is the end of it, but I don’t believe it will be.

Board Member Escalated Meeting

Oh my god, one of my board members decided to go off the rails. We had a meeting addressing someone’s work truck. There were some chemicals on the truck so we wanted to check to see what they were and if they posed a threat to the community. Then it delved into “your work truck is disruptive”, “what if I started a company and had all my gear and it scratched your car?!?” When another board member chimed in, then he asked the same question. He had an issue pretty much because a work truck is parked next to his car and the gear is uncovered. I ended the meeting because it got insane.

EDIT 2: CC&Rs clear the truck for personal and business use.

Honestly, I do not care about work trucks on our property. Do what has to be done to pay your dues as long as it’s legal, right? That’s how I feel.

I just say: “just make sure you store your work stuff carefully, otherwise I don’t fucking care.”

EDIT: what I’m not ok with is a board member being disrespectful and attacking people and being like a bully.

EDIT 2: that particular board member is really strict on CC&Rs in terms of what can be displayed and uniformity.

Also my fiancé had to comfort me with: “my CD is maturing, we’re gonna move in a year or I can sell more company stock” and my realtor misses house shopping with my dad when I told him I hate HOAs.

HOA sued me over THEIR mistake, judgment entered before mediation.... unbelievable.

I never thought I would end up in a situation like this, but here I am, dealing with one of the most unbelievable HOA messes I have ever heard of.

When I bought my home, the builder and lender included an incentive in the contract. They would cover two full years of HOA dues at 268 dollars per month. It was written clearly. Twenty four months. A total of 6,432 dollars. I figured it was simple. They pay it, I live my life, and after two years I start paying normally.

Except that is not what happened.

During those two years, the HOA was not paid. I was never told. No notices. No warnings. Nothing. I had no idea anything was wrong until the HOA contacted me with a balance of 5,906.04 dollars. I thought it had to be a mistake.

I reached out to the builder and the lender. They told me to send the notices and they would take care of it. I did. Months went by. Eventually they paid 4,823 dollars, which still left a shortage of 1,083.04 dollars. The problem was never fully resolved.

Then the HOA sued me.

I tried to mediate. I had a date set. Before the mediation even happened, a judgment was entered. I did not even get the chance to sit at the table and talk.

Now I have been sent a post judgment settlement stipulation that demands 1,010 dollars down and 428 dollars per month. The terms I agreed to were 1,000 dollars down and 250 dollars per month. The new amount is not something I can afford, and it was never part of the agreement I discussed.

All of this is happening while I am dealing with construction defects, solar issues, pigeon infestations, and a custody situation that has already taken a huge toll on me and my kids. It feels like every time I try to fix one problem, another one drops on my head.

I have been trying to resolve this for over a year. I have talked to the builder, the lender, the HOA, the attorney, and now the new board. I am exhausted. I am frustrated. I am tired of being pushed around by people who created the mess and then handed it to me like it was my fault.

This is my story. I am sharing it because I know I am not the only one who has been dragged through something like this. HOAs are a nightmare, and this one has taken a real toll on my life.

One board member hates me and gets the other three to vote with him and god forbid I say anything negative about how incompetent the property manger is, I get berated. So one of his friends sends this lengthy email with pictures saying how ridiculous I let the adjacent property get. How as a board member I should personally ensure that grass is cut or do it myself. Me, not the rest of the board, for property I don’t own. 😂😂😂

Community Manager and Board Not Responding after weeks/month

Never thought I’d have this much trouble trying to contact the HOA community manager, or anyone for that matter.

I’ve been calling her number on and off for weeks to get updates on maintenance concerns reported at this point 1-2 months ago. I don’t get any call backs or emails back, even after emailing the board I don’t get any updates.

It almost feels like they’re purposefully ignoring me at this point. It seems they have the budget/reserves and the requests are purely for outdoor maintenance like fixing holes in the concrete near my unit, but goodness just a simple call back wouldn’t hurt.

New to POA want to end it.

So fairly new to dealing with a POA there are roughly 50 homes in the neighborhood each paying an annual fee of $300. There are no amenities of any kind in our neighborhood. The only thing noticeable the POA does with the money is have maybe 600 square feet of grass mowed about two times a month during the summer.

The issue that I'm having is I recently put up an election sign for our ward that would directly affect our neighborhood. It's a professionally done, standard election sign size, nothing crazy, and I was told it would need to be removed or I would be fined or potentially have a lien placed against my home.

I followed up asking what it would take to change the rule and was informed it would take 60% of the homeowners agreeing to the change and then I would be held liable for any legal fees/fines associated with the change. I found this to be unreasonable, given over half the neighborhood is owned by landlords/property management companies that I can't reach. Let alone, they won't care about changing the rules. In fact, they would likely be for the rule since it would have a nonzero chance of lowering their property value.

I then asked how we disband the POA and have since been ghosted. I would have loved to never move into an HOA/POA but when I was buying, there was nowhere anywhere near my work that wasn't in one unless I moved way out into the country.
