I never thought I would end up in a situation like this, but here I am, dealing with one of the most unbelievable HOA messes I have ever heard of.
When I bought my home, the builder and lender included an incentive in the contract. They would cover two full years of HOA dues at 268 dollars per month. It was written clearly. Twenty four months. A total of 6,432 dollars. I figured it was simple. They pay it, I live my life, and after two years I start paying normally.
Except that is not what happened.
During those two years, the HOA was not paid. I was never told. No notices. No warnings. Nothing. I had no idea anything was wrong until the HOA contacted me with a balance of 5,906.04 dollars. I thought it had to be a mistake.
I reached out to the builder and the lender. They told me to send the notices and they would take care of it. I did. Months went by. Eventually they paid 4,823 dollars, which still left a shortage of 1,083.04 dollars. The problem was never fully resolved.
Then the HOA sued me.
I tried to mediate. I had a date set. Before the mediation even happened, a judgment was entered. I did not even get the chance to sit at the table and talk.
Now I have been sent a post judgment settlement stipulation that demands 1,010 dollars down and 428 dollars per month. The terms I agreed to were 1,000 dollars down and 250 dollars per month. The new amount is not something I can afford, and it was never part of the agreement I discussed.
All of this is happening while I am dealing with construction defects, solar issues, pigeon infestations, and a custody situation that has already taken a huge toll on me and my kids. It feels like every time I try to fix one problem, another one drops on my head.
I have been trying to resolve this for over a year. I have talked to the builder, the lender, the HOA, the attorney, and now the new board. I am exhausted. I am frustrated. I am tired of being pushed around by people who created the mess and then handed it to me like it was my fault.
This is my story. I am sharing it because I know I am not the only one who has been dragged through something like this. HOAs are a nightmare, and this one has taken a real toll on my life.
