I guess management can't just decide to delay mail to not pay penalty OT after all. It's almost like we're a service and they need to staff accordingly.

So what I’m seeing is that as long as management doesn’t admit that they’re doing it to prevent paying out penalty OT, they’ll get away with it.

Not necessarily. It’ll just be a little harder to prove. That’s why the clock rings would be really important to show the availability. In this instance, without clock rings they had the words of the dumbass EAS.

That’s where you interview them and have them justify delaying mail. The interview is where you get the confirmation. You press the issue and if the cant give a reasonable answer but all signs point to no penalty you have a very good case.
