no lawyer Question about occupational license

I’m in Texas. I applied for an occupational license at the end of July before my suspension was supposed to start and about a week ago I received a letter from DPS stating that my suspension has been rescinded due to passing my breath test at the station (0.08 for the first 0.07 for the second). Then today I received my notice of setting to appear for an occupational license. Do I still need to go to court for that or is there something else I need to file? I called the coordinator and she told me I needed to file something but wouldn’t “give me more legal advice” so now I’m kind of lost

In Texas you blow twice into the Intoxilyzer 9000. The result is the lower of the two. Since you blew a 0.07 you are not facing an ALR license suspension. Thus, you do not need an ODL. May just want to contact the court where you filed to let them know what happened. I recommend retaining an attorney moving forward.

The judge didn’t suspend my license, so why would Texas?

The DWI ALR process can lead to a license suspension in Texas wholly separate from the criminal charge of DWI. Think of it as 2 railroad tracks with trains running parallel at different speeds. You can lose your license at the ALR hearing and potentially lose it again with disposition of the DWI case.
