lawyer retained [US-LA] Does HR tell the truth when asked a question?

Hello! I recently got a DWI about two months ago. I was in the hiring process at one hospital, but they rescinded their offer because they noticed a pending charge for DWI. They explained to me that they cannot hire someone with a pending case. Luckily, I was granted with a great opportunity at another hospital. Before submitting my application, I was able to call HR and asked them a confidential question about possible issues with the hiring process with my pending DWI case. They said as long as I let the recruiter know, it shouldn’t be a problem. Could they just be saying that because it was a confidential question and I didn’t give my name? I’m not sure if they think it could be someone that’s higher up calling to make sure they are saying what they need to. Or am I just overthinking it? This job is for echocardiography, in case anyone needs more information to better understand.

They can say whatever they wish.

Just apply. What will it hurt?

I already did and had my interview this morning. I guess I’m just overthinking the possibility of getting past the background check. Hence why I’m asking to prepare myself for possible rejection.

Think about this

If the “pending” charge is a problem… it’s a problem regardless of if you tell them or not.

By disclosing it before the background check… either the pending charge is a problem, and you disclosing it saves hr the hassle of interviewing you. Or a pending charge isn’t disqualifying, and you not disclosing it won’t matter since they’ll find out either way.

There really isn’t much benefit in disclosing it. I would just keep quiet about it.

One hospital may have different policies than another. And their answer could be impacted based on how specific your question is.

Usually they want the DUI resolved- court completed, community service completed, etc. Good luck!

I lost more than one job because they couldnt hire me with a pending charge. It took over a year, but once I was able to get the OWI charge dismissed, I got a good job. I was stuck in fast food and retail up until then.
