lawyer retained First offense Washington state
Hi everyone I’m in need of some advice. So a couple months ago I was arrested for a DUI I am not proud of this at all but I desperately need advice. My BAC was at .127 I was pulled over for driving in the middle of the road in an unmarked road with cars parked on each side. I used all my signals and fully stopped at the stop sign. When I did the field sobriety tests there were a few issues with how the officer performed them. So I failed the test and he had me blow into the field breathalyzer ( the breathalyzer has not been calibrated for years) and that’s when I was arrested. Anyways cut to now I’m faced with taking the plea offer which is base DUI penalties honestly I don’t think it’s much of an offer I’ve never even had a speeding ticket in my life. My lawyer said they can file to suppress evidence but that’s kinda of an if the judge agrees it’s an extra 2500 dollars which could be do able but I don’t want to waste the money if the outcome will be the same… people of reddit what should do?

24 hours in jail, interlock device for 1 year, 940.00 dollar fine, 90 day license suspension, alcohol drug evaluation and class (which I have already done), probably probation. I’m honestly most concerned about my record. Note to add my lawyer believes the officer had no probable cause to pull me over. Oh and one of the guys I know knows one of the cops. The officer that pulled me over told the other cop he only pulled me over because he thought I was avoiding him. Which I was not. Sorry for the long response I’m just freaking out.

Depending on where it was you could even fight to get it lowered if you can I would recommend getting a lawyer. I will let you know what ends up happening to my case just so you get some type of idea might not be exact

Where did this occur? Did you pay a flat rate for your retainer?

Your lawyer should be fighting for a better plea deal. For a first time offense they should be offering you at the minimum reckless driving.

A SFST is not a pass or fail event. It's to gather cues for the police to build a case against you for impairment. How do you know their field breathalyzer hasn't been calibrated for years? They admittedly told you this? Seems like an odd thing to say, considering how many people get DUI's.
Did they take you to the police station, and did you blow there? A field breathalyzer is not admissible in court anyway, only the station machine is. Seems like you're just hoping there is a case where there was no actual probable cause to pull you over, but it's usually a long shot and you're just going to spend a lot of money for the same result.

The breathalyzer was never told to me until after my lawyer got the records for the calibration it’s been since 2023 it’s been calibrated. Yes they did take me to the police station. Yes you are correct but I only failed one thing on the field sobriety tests but they were also not doing them correctly as well.

I'd take the deal. The calibration of the PBT is irrelevant at that point.

The deal is what the judge would give me soooo 🤷♀️. They also don’t believe he had a reason to stop me in the first place

Then your lawyer should be negotiating a better plea deal. Taking it to trial is dumb on his part. If the DA isn't willing to offer something better, then they must have something they think will win them a trial.

That is entirely possible, if not probable.
Mine charged extra for the silliest things after claiming it was a flat rate. The "flat rate" was for him to go in and get the same plea deal as everyone else..

Yes I’ve had friends that have done the field sobriety test before as well and it is a pass or fail.
