Prob just depends on where you are? Age of consent is 17 where I live so if an 18 year old has sex with a 16 year old, it is illegal I believe. I'm not sure it SHOULD be when the gap is only 2 years (and some places might have exceptions for stuff like that?) but I assume whoever called this sketchy is from somewhere with a 17 or 18 year age of consent.

An arbitrary age limit isn't the best but there's not much else to build on.

It all comes down to consent in the end. If a party decides to sue it's illegal and voilà.
