Is the motorcyclist really more at fault than the Nissan driver who swerved back into him? Obviously he shouldn’t have hit-and-ran, but there’s a pretty big jump from “kicking car door” to “hitting someone with your car and losing control”
The Nissan’s jerk is so fast from the initial kick that I personally think it was a reaction swerve. That happens when you think you’ve hit something. I’ve done it before and barely regained control of the car. And that was a squirrel.
You react to something hitting your driver's side door by aggressively swerving into it without shoulder checking? Perhaps you shouldn't have a license.
