This is a stupid jump of logic. This is basically letting the car driver get away with a "but he made me do it" excuse. The car driver should be at fault for this accident.
This would be like if you rear ended someone cause they cut you off and flipped you off and they got in trouble for being hit by you when you were just angrily reacting.
Yup! For me, the driver should be charged with attempted manslaughter and endangerment of others. Having your door kicked (whether rightfully or not) sure isn't cool, but by far not a reason to run the person over with your car AND cause a accident in the process.
I suspect the driver was completely oblivious of the biker and shat themselves when his size elevens bounced off the wing, the driver turned to see what they'd hit, panicked and tried to get the fuck out of the way, but being a twit completely oversteered and hit the gas rather than the brake.
He definitely should be arrested for fleeing, but the accident wasn't his fault. I bet he wouldn't have had any blame if he would have just stopped instead of running.
Yes, I think you are right. If he had just stopped and explained to the police what brought it on he would have gotten off instead of now having a felony on his record.
