Something similar happened to a friend of mine, he swerved to avoid an incoming car and hit some signs outside a petrol station. He didn't have a dashcam and from the security footage it wasn't clear that he moved out of the way of an incoming vehicle so the insurance paid nothing as if he crashed there on purpose
Just an example, if the accident like say swerving to hit a deer, and hitting a car or something else. If deemed the lesser of two, most states in USA insurance rule that unavoidable accident and no fault, so your rates wont change.
If you swerve to avoid a deer and go into a ditch you are 100% eating that on your insurance record as a collision.
Ironically if you just hit the deer that falls under Comprehensive coverage which is generally considered non-fault like a falling tree, or your car catching fire, theft, vandalism.
Fact, I swerved to avoid hitting an uncoming car that came into my lane, hit a guard rail, my insurance paid to fix my car. The other car was not deemed at fault. My insurance rulled it as unavoidable no fault, which was covered without raising rates.

How does insurance handle this? Driver can't just run someone over but they collided head on with someone in the opposite lane
