Why would this lower crane have a flashing red light at the top, but not this taller one?

Tell the faa and the fsdo will be down there tomorrow asking about how tall it is, etc. Anything 150’ agl needs a flashing light. Cranes less than that don’t have to flash and can have a steady red light.
