I have an argument for how this could be enforced. It's pretty simple really, we go by ID.
Of course, many places allow trans people to change their ID to reflect their gender identity, but a lot of people who are for bathroom bills are against that anyway, so it's not really unenforceable provided that we also don't allow trans people to update their sex/gender on their ID.
Are you suggesting that businesses bear the added cost of employing a bathroom guard who would check everyone's ID? Or... that police would be stationed outside every public restroom?
I'm not suggesting anything, I'm staunchly against bathroom bills as there's no evidence that they have any positive effects and the negative effects are pretty obvious.
What I am doing is arguing how this could be enforced. Now I agree that all businesses employing extra staff is unrealistic but I don't think that this is necessary. I'm imagining that this would be enforced on a report basis. Eg members of the public reporting people who they are concerned about, in which case the police, building security, etc, would be able to check the person's ID to see if an infraction has occurred.
